HomeMy WebLinkAbout~Master - Amending Zoning Regulations Pertaining to Corner Lot Setback Requirements ORDINANCE NO. 3738 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SUBSECTIONS 29.402(5), 29.408(2)(b)(i), 29.408(7)(a)(i)a,29.701(3),29.702(3)AND 29.703(3);RE-ADOPTING THOSE SUBSECTIONS AMENDED FOR THE PURPOSE OF REVISING THE ZONING REGULATIONS PERTAINING TO CORNER LOT SETBACK REQUIREMENTS;REPEALING ANY AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT TO THE EXTENT OF SUCH CONFLICT; PROVIDING A PENALTY;AND ESTABLISHING AN EFFECTIVE DATE. BE IT ENACTED,by the City Council for the City of Ames,Iowa,that: Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by repealing subsections 29.402(5),29.408(2)(b)(i),29.408(7)(a)(i)a,29.701(3),29.702(3),and29.703(3)andre-adopting those subsections revised to state as follows: "See.29.402. SETBACKS. (5) Through Lots and Corner Lots. On through lots,and corner lots with two or more abutting streets, except lots within the RL, RM, and UCRM Zoning Districts, the required front setback shall be provided on all streets. Sec.29.408. OTHER GENERAL DEVELOPMENT STANDARDS. (2)Fences (b)Location and Height (i) The maximum height for fences in required frontbuilding setacks, and the side yard setbacks adjacent to public right-of-way,in the case of corner lots,is 4 feet,except: a. In the case of through lots a maximum fence height of six(6)feet is permitted along the functional rear lot line,subject to a five-foot setback being provided with a landscaping element equal to one landscape tree for every 50 lineal feet and two high or three low shrubs for every ten lineal feet of area to be planted. The landscaping shall be planted within the five-foot setback area; b. In no instance is a fence that is taller than four feet in height permitted within the functional front yard. For the purposes of this section,the functional front yard is defined as the area located between the main front wall of the residence and the front lot line. (7) Requirements for Private Garages and Other Accessory Buildings. (a) The following requirements apply to private garages and accessory buildings in Agricultural,Residential and Hospital/Medical districts: (i) Location Within Setbacks. a. No detached garage or accessory building is allowed in the front yard,or within the side yard setback adjacent to public right-of-way in the case of corner lots. Violation of the provisions of this ordinance shall constitute a municipal infraction punishable by a penalty of$500 for a persons first violation thereof,and a penalty of$750 for each repeat violation. Section Three. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict,if any. Section Four. This ordinance shall be in full force and effect from and after its passage and publication as required bylaw.
