I wanted you to know that the staff will be reviewing this draft before we roll it out at a Council meeting. Since we don't change our garbage handling regulations very often, we also want to touch bases with the local haulers, who are some of our most important partners in this business! We'll try to have the ordinance to you at your second meeting in July. I will send a hard copy to each of you. I will now ask Lynette to arrange a 1-hour meeting for us as staff to discuss this where each person can bring their input and comments. John Pohlman has suggested that we then take this issue to the haulers before an ordinance is presented to City Council for their approval, so as to get the benefit of insights from those"closest to the problem." When we get together we may identify other"users"who we should touch bases with. Also, at the suggestion of the Public Works Director, Section 10.9 is amended to shorten,from 10 days to seven days,the length of time that garbage,yard waste and refuse can be kept. AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES,IOWA,BY REPEALING SECTION 10.3 AND SECTION 10.9 AND RE-ADOPTING THE SAME REVISED TO REQUIRE HARD CONTAINERS FOR GARBAGE AND TO REQUIRE COLLECTION IN SEVEN DAYS INSTEAD OF TEN;PROVIDING A PENALTY REPEALING ORDINANCES IN CONFLICT; AND ESTABLISHING AN EFFECTIVE DATE. BE IT ENACTED,by the City Council for the City of Ames,Iowa,that: Section One. The Municipal Code of the City of Ames, Iowa shall be and is hereby amended by repealing Sections 10.3 and 10.9 thereof and re-adopting those sections to state as follows: "Sec. 10.3. GARBAGE RECEPTACLES. Garbage shall not be set outdoors for collection and disposal,or for any other purpose,except when fully contained in a water-tight and tightly closed hard receptacle that cannot be ripped open by birds or beasts. Setting out garbage in plastic bags or paper sacks is prohibited. Sec.10.9. DEPOSITING GARBAGE, YARD WASTE, REFUSE IN STREETS, ALLEYS,ETC.,PROHIBITED;EXCEPTION. (1) It is unlawful for any person to deposit or place any garbage,yard waste,or refuse in any street, alley, lane,public place,private property or any body of water within the city; or,to permit garbage,yard waste or refuse to remain for more than seven days on private property that is under one's ownership,possession or control. However,garbage,refuse or yard waste may be placed on the untraveled portions of streets,alleys,lanes,public places and on private property to be hauled away if the garbage,refuse or yard waste is kept in the manner prescribed in this chapter. Yard waste may be retained more than seven days if composting is being completed. (2) It is unlawful to place garbage, refuse or yard waste on the private property of another, or into another's garbage,refuse or yard waste containers for the purpose of being hauled away. Violation of this ordinance is a municipal infraction punishable by a penalty of$500.00 for a first violation and$750.00 for each repeat violation. Section Three. Any and all ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict,if any. Section Four.
