HomeMy WebLinkAbout~Master - Amend Occupancy Limits of the Rental Housing Regulation in the RL and UCRM Zones ORDINANCE NO. 3721 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SUBSECTION 13.36(2) AND RE- ENACTING THE SAME REVISED TO AMEND OCCUPANCY LIMITS OF THE RENTAL HOUSING REGULATIONS FOR HOUSES IN THE RL AND UCRM ZONING DISTRICTS;REPEALING ANY AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT TO THE EXTENT OF SUCH CONFLICT; PROVIDING A PENALTY; AND ESTABLISHING AN EFFECTIVE DATE. BE IT ENACTED,by the City Council for the City of Ames,Iowa,that: Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by repealing subsection 13.36(2)thereof and re-adopting the same revised to state as follows: "See. 13.36. MAXIMUM OCCUPANCY. (2) RL and UCRM zoning districts - Single Family and Two Family Dwellings. Notwithstanding an excess of floor space over that required by subsection(1) above, in all single family and two family dwellings in the RL and UCRM zoning districts the maximum occupancy of a dwelling unit shall be one family. Houses that were in the R-3 or R-4 zoning districts prior to May 1, 2000 shall, if shown by a Letter of Compliance to have been then lawfully occupied by five unrelated persons, be qualified for continued occupancy by as many as five unrelated persons until August 1, 2006 provided that: (a) any house so occupied continues to have the off-street parking spaces and other features that enabled it to qualify for occupancy by up to five unrelated persons under the prior regulations; (b)the house is not sold after June 1, 2003;and(c)there is no change in the use and occupancy of the house." Section Two. Violation of the provisions of this ordinance shall constitute a municipal infraction punishable by a penalty of$500 for a person's first violation thereof,and a penalty of$750 for each repeat violation. Section Three. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict, if any. Section Four.
