COUNCIL ACTION FORM
SUBJECT: REZONING OF PROPERTY GENERALLY LOCATED ALONG THE EAST SIDE OF
SHERMAN AVENUE NORTH OF SOUTH 3RD STREET, AS THE "O-SLF" (SOUTH LINCOLN
FRINGE OVERLAY DISTRICT).
BACKGROUND:
Following approval of the Sub-Area Plan for the South Lincoln Neighborhood in January 2003 the
Ames City Council initiated an amendment to the Zoning Ordinance. The Council also initiated
rezoning of property generally located along the east side of Sherman Avenue north of South 3rd
Street (see Attachment A). The area west of Sherman Avenue is zoned for a mixture of
commercial and residential uses, with design standards to encourage pedestrian scale building
masses and other characteristics compatible with the traditional character of the neighborhood.
The area east of Sherman Avenue is zoned for Highway-Oriented Commercial development with
its land uses, size of buildings and parking lots, building placement and orientation, and other
redevelopment characteristics strongly influenced by development along Duff Avenue.
These two land uses facing each other across Sherman Avenue may create conflicts that may
reduce the development potential of either area. The proposed rezoning would reduce the
potential for such conflicts by reinforcing the identity and function of Sherman Avenue as a public
street toward which buildings are oriented.
AREA TO BE REZONED:
This rezoning proposal applies a new overlay zoning district to the eastern fringe of the South
Lincoln neighborhood. The area to which this overlay district would be applied is the half-block
wide area between Sherman Avenue and the north-south, mid-block alley to the east, and
between the east-west, mid-block alley one-half block south of Lincoln Way south to South 3rd
Street (see Attachment A).
Existing and Proposed Zoning. The current zoning of the subject property is "HOC' (Highway-
Oriented Commercial, see Attachment B). This would remain as the base zone, whose standards
would still apply to the subject property. All of the currently permitted uses would remain. The
proposed zoning is "O-SLF" (South Lincoln Fringe Overlay District), which would add to the
development standards for the area, as described below.
AMENDMENT TO ZONING ORDINANCE:
The amendment to the Zoning Ordinance will create a new overlay district that is specific to the
area described above. As an overlay zone, it is intended to supplement the base zone in order
to establish an orderly transition between land uses.
Permitted Uses.
• Permitted Uses are established by the base zone, "HOC' (Highway-Oriented Commercial) and
are not changed by the new overlay zone.
Development Standards.
• The ordinance requires that buildings along Sherman Avenue have their fronts facing Sherman
Avenue, in that for lots that abut Sherman Avenue the front yard and primary commercial
entrance will be on Sherman Avenue.
• Other existing development standards of the Zoning Ordinance continue to apply.
PROCESS FOR AMENDING ZONING TEXT AND MAP:
The City Council has initiated an amendment to the text of the Zoning Ordinance and a rezoning
of the subject property. Under this Council-initiated rezoning process, the review and
recommendation by the Planning and Zoning Commission of November 6, 2002 constitutes its
required report (Section 29.1506 (1)). In January 2003, the City Council directed staff to re-
examine the text amendment, which has resulted in the current proposal for the provisions that
will apply to the area subject to this rezoning.
ALTERNATIVES:
1. The City Council can approve the proposed rezoning of the property generally located
along the east side of Sherman Avenue north of South 3rd Street, as the "O-SLF" (South Lincoln
Fringe Overlay District).
2. The City Council can deny approval of the proposed rezoning of the property generally
located along the east side of Sherman Avenue north of South 3rd Street, as the "O-SLF" (South
Lincoln Fringe Overlay District).
3. The City Council can modify the proposal for rezoning of the property generally located
along the east side of Sherman Avenue north of South 3rd Street as the "O-SLF" (South Lincoln
Fringe Overlay District).
4. The City Council can postpone action on this proposed rezoning and refer it back to City
staff for additional information.
MANAGER'S RECOMMENDED ACTION:
It is recommended that Alternative #1 be adopted. This is a recommendation that the City Council
approve the proposed rezoning of the property generally located along the east side of Sherman
Avenue north of South 3rd Street, as the "O-SLF" (South Lincoln Fringe Overlay District).
By continuing the identity and function of Sherman Avenue as a public street toward which
buildings are oriented, the overlay zoning district will be an important step toward accomplishing
the City's goals for the South Lincoln neighborhood. Allowing previously-permitted uses to
continue on the east side of Sherman Avenue and avoiding new design standards will provide
opportunities for further commercial redevelopment in the vicinity of Duff Avenue.
