COUNCIL ACTION FORM
SUBJECT: REVISION OF PARKING REGULATIONS ON FIFTH STREET
BACKGROUND:
As work on the city power plant neared completion, staff was asked to remove the
temporary parking restrictions that had been installed on Fifth Street between Duff
Avenue and Carroll Avenue to facilitate construction. While restoring the parking to its
original condition, staff was advised that there was a no parking ordinance in the City
Code for this area that has never been signed in the field. Staff also noted a reserved
parking space that was not in the City Code. Furthermore staff found another parking
ordinance in the City Code that is no longer appropriate.
Currently parking is prohibited on the south side of Fifth Street from the alley between
Duff Avenue and Carroll Avenue west 70 feet. Staff has been advised that this parking
ordinance was approved when the property at this location was being used as a lumber
yard but that the signs were mounted on the buildings that burned down. Staff believes
that parking could be allowed in this area.
Staff noted that there was a reserved parking space on the south side of Duff Avenue
within the intersection of Carroll Avenue. The sign reserves a parking space for visitors
to the power plant. Apparently the sign was installed when the east leg of Fifth Street at
this location was vacated as part of the improvements to city facilities that created a
campus atmosphere in this area. Typically it is illegal to park within an intersection.
Therefore staff recommends moving this reserved parking space west of the
intersection. The power plant staff has no objection to this proposal.
City staff also noticed that there is a no parking ordinance in the City Code that makes it
illegal to park on the south side of Fifth Street from Carroll Avenue east 170 feet. This
ordinance is no longer needed since this portion of Fifth Street has been vacated and
the subject area was redeveloped as part of the previously mentioned campus type
improvements.
ALTERNATIVES:
1. Direct the City Attorney to develop an ordinance to remove the existing no
parking ordinance on the south side of Fifth Street at the alley between Duff Avenue
and Carroll Avenue from the alley west 70 feet, remove the existing parking ordinance
on the south side of Fifth Street from Carroll Avenue to 170 feet east of Carroll Avenue,
and to provide a reserved parking space for power plant visitors on the south side of
Fifth Street 60 feet west of Carroll Avenue.
2. Direct the City Attorney to develop an ordinance to remove the existing no
parking ordinance on the south side of Fifth Street at the alley between Duff Avenue
and Carroll Avenue from the alley west 70 feet.
3. Direct the City Attorney to write an ordinance to reserve a parking space for
power plant visitors on the south side of Fifth Street 60 feet west of Carroll Avenue.
4. Direct the City Attorney to develop an ordinance to remove the existing no
parking ordinance on the south side of Fifth Street from Carroll Avenue to 170 feet east
of Carroll Avenue.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt alternative
number one above and direct the City Attorney to develop an ordinance to remove the
existing no parking ordinance on the south side of Fifth Street at the alley between Duff
Avenue and Carroll Avenue from the alley west 70 feet, remove the existing parking
ordinance on the south side of Fifth Street from Carroll Avenue to 170 feet east of
Carroll Avenue, and to provide a reserved parking space for power plant visitors on the
south side of Fifth Street 60 feet west of Carroll Avenue.
