Only if they are put out for pick-up on the day that pick-up is scheduled. As I said to Council when the
ordinance was voted on, in preparing the many drafts of the ordinance, various periods of time that the
items could be out were considered and rejected by comments received. Staff does not want to have to
deal with proving how long an item has been out. The City council does not want to have to defend
against criticism for allowing indoor furniture to be out for any period of time. Therefore. as I said at the
council meeting, disposal of these items must be done "quickly". Just setting them out when you move
out with no arrangement for expeditious pick-up will be a violation. This is a matter of refuse disposal
governed by section 10.8 of the Municipal Code. I do not know who is in charge of enforcement. My
guess would be the Sanitarian.
