Phone: 515-239-5146 •Fax: 515-239-5142 May 10, 2002 The Honorable Ted Tedesco,Mayor And Members of the City Council Of The City of Ames, Iowa Re: Revised Ordinance Alternatives on Outdoor Use of Indoor Furniture on Rental Properties Dear Mayor Tedesco and Council Members: On the agenda you have before you two different versions of the proposed ordinance relating to outdoor use of indoor furniture. The shorter version (Version A), was the revision made at your meeting of April 23. The other, slightly longer version(Version B) derives from communication received from Council Member Quirmbach, who on further consideration of the matter, did not intend to weaken the ordinance as it relates to lawn use of indoor furniture,but did want to allow some limited use of indoor furniture on porches. AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA,BY REPEALING SUBSECTION 13.38(3)(L)THEREOF AND RE-ENACTING THE SAME REVISED FOR THE PURPOSE OF PROHIBITING THE PLACEMENT OF UPHOLSTERED INDOOR TYPE FURNITURE ON UNENCLOSED PORCHES AND YARDS OF RENTAL HOUSING; REPEALING ANY AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT TO THE EXTENT OF SUCH CONFLICT; PROVIDING A PENALTY;AND ESTABLISHING AN EFFECTIVE DATE. BE IT ENACTED,by the City Council for the City of Ames,Iowa,that: Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by repealing Subsection 13.38(3)(1)and re-enacting it to read as follows: "(1) Occupants shall not permit to remain overnight, on the yards or open porch areas, any upholstered furniture,or other furniture,manufactured for use indoors." Section Two. Violation of the provisions of this ordinance shall constitute a municipal infraction punishable as set out in Section 1.9 of this Code. Section Three. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict,if any. Section Four. This ordinance shall be in full force and effect from and after its passage and publication as required by law. Passed this day of ,2002.
