Re: Prohibition of Unlimited Quantities of Alcoholic Beverage
Dear Mayor Tedesco and Council Members:
At the Council's meeting of December 17, it was directed that the City Attorney draft an ordinance
to prohibit serving unlimited or indefinite quantities of alcoholic beverage for a single pre-set payment.
With this is the draft.
The draft ordinance is essentially the same as what has been enacted in this regard by the cities of
West Des Moines, Clive, Waukee and Iowa City. The draft incorporates our present prohibition of
"indirect sales"found at Sec. 17.18.1 of the Ames Code,that was enacted in 1989 in response to the
practice of selling a cup and allowing the purchaser to fill it until the kegs went dry. The draft does
not have the provision that the other cities have for the Council to grant special exemptions on request.
It is my thought that the Council would not want to have to consider such requests without stated
standards for granting or denying the exemption. However,the draft ordinance does have exceptions
provided so that events at which access is restricted to an invited group(banquets,weddings,etc.)are
not interfered with.
