BILLY SUNDAY ROAD LAND USE OPTIONS: Brian O'Connell gave a chronological history
leading up to the preparation of the report detailing the land use and development alternatives
for Billy Sunday Road.Mr.O'Connell stated that the key issue surrounding the analysis of this
area is access. He said that the intersection of Duff Avenue with Billy Sunday Road is poor,
traffic from the soccer complex/existing land uses negatively affects the intersection,and more
development in this area would only worsen this situation.
It was pointed out that in 1999,Brent Haverkamp purchased 16 acres of land generally located
on the south side of Billy Sunday Road, east of South Duff Avenue, and the land was
subdivided into five lots. Mr. O'Connell reminded the Council that on January 2, 2002, they
received a letter from property owner Brent Haverkamp's engineer requesting a change to the
land use designation and zoning classification for his remaining vacant parcels. In the letter it
was stated that the property owner requested a change that would allow the continuation of
mixed residential/commercial development similar to the land uses that have been developed
to the east.Mr.Haverkamp requested a change that would allow for Residential High-Density
zoning or a change to the text of the Zoning Ordinance that would permit mixed uses.
Mr. O'Connell advised the City Council that staff had made an error in the calculation of
projected traffic. On Page 7 of the Report, the table showed Mixed Use producing 454
trips/day and Commercial Use producing 160 trips/day. The Report stated that "office uses
produce an average of four trips per 1000 square feet of space per day...";however,office uses
produce an average of four trips per employee per day. Therefore, the total trips generated
from mixed-use development
would be 572,and the total trips generated from Highway-Oriented Commercial development
would be 646.
Mr. O'Connell summarized the existing conditions of the subject property, specifically, the
land use, zoning, sanitary sewer and water, and storm sewer.
The City Council was told by Mr. O'Connell that staff has investigated the consequences of
changing the Land Use Policy Plan (LUPP) designation for the subject area and the
surrounding area(all the land located south of U. S. Highway 30, west of Skunk River, east
of South Duff Avenue,and north of the existing residential development along Crystal Street).
Mr. O'Connell detailed the following five scenarios derived from staff analysis of the
requested land use change.
1. The subject property will remain zoned and planned as Highway-Oriented Commercial
and no near-term improvements will be made to Billy Sunday Road. The surrounding
area will remain unchanged.
2. The subject property will be rezoned and planned to Residential High Density and no
near-term improvements will be made to Billy Sunday Road.The surrounding area will
remain unchanged.

3. The subject area will be rezoned and planned to Residential High Density and right-of-
way will be dedicated to the City to accommodate potential future connections through
the State of Iowa Nursery site. The surrounding area will remain unchanged.
4. The subj ect area will be rezoned and planned to Residential High Density,right-of-way
will be dedicated to the City by the property owner to accommodate future connections
through the State of Iowa Nursery,and right-of-way will be obtained from the State of
Iowa Nursery. The developable portion of the City's land will be sold to a developer
and marketed for commercial uses.
5. The subject area will be rezoned to Residential High Density, right-of-way will be
dedicated to the City to accommodate future connections through the State of Iowa
Nursery, right-of-way will be obtained from the State of Iowa Nursery, and the State
of Iowa Nursery will be planned for Highway-Oriented Commercial,Residential High
Density, Residential Medium Density, and Residential Low Density land uses. The
developable portion of the City and State's land will be sold to a developer marketed
for commercial/residential land uses.
Mr. O'Connell gave a breakdown of infrastructure costs associated with improving Billy
Sunday Road and extending roads through the State's property.
It was indicated that staff felt Scenario 3 would be the best alternative.Mr. O'Connell advised
that this Scenario takes into account that the area is not ideal for various types of highway-
oriented activities permitted under the HOC zone and uses on the subject property would most
likely be limited to office-type uses. He also said that it would permit the development of
mixed-commercial and high-density residential uses, thus providing a greater land use
opportunity for the subject area. Mr. O'Connell further stated that if right-of-way could be
made available on the subject area to allow for future street connections through the State-
owned property to the south, then a long-term solution would be provided to mitigate the
greater impact that multi-family traffic will have on Billy Sunday Road and its intersection
with Duff Avenue.However,Mr.O'Connell indicated that the negative aspect of this Scenario
is that the short-term Billy Sunday Road users will experience elevated traffic problems.
Brent Haverkamp, 4915 Timbercreek Lane, Ames, asked for a clarification of what is being
recommended by staff. Mr.O'Connell stated that the information provided to the City Council
is a report.If the City Council chooses to make a recommendation,staff prefers that they select
Scenario 3.
Mr. Haverkamp said he feels that the road and the intersection are sufficient to accommodate
all the traffic that would be generated as a result of his property development. He stated that
he has developed two of his lots, constructing three high-quality, mixed-use buildings. The
Council was advised that he purchased approximately 16 acres of ground in 1999,and in order
to develop the property, the City made the requirement that he pay for the extension of Billy
Sunday Road, the associated utilities, and the bike path. Mr. Haverkamp advised that he did
bear the entire cost of those improvements, and now the City is saying that the road is
"substandard." In Mr. Haverkamp's opinion, the mixed-use development being proposed
would produce less traffic than an HOC development.Mr.Haverkamp stated that the right-of-
way being asked for by the City constitutes approximately 15% of his remaining property.
Moved by Goodhue,seconded by Cross,to refer to the Planning and Zoning Commission with
the recommendation that Scenario 2 be selected.
Moved by Hoffinan, seconded by Wirth, to amend the motion to include Scenario 3 as an
option.
Vote on Amendment: 2-4. Voting aye: Hoffman, Wirth. Voting nay: Cross, Goodhue,
Quirmbach, Vegge. Motion failed.
Vote on Original Motion:5-1.Voting aye:Cross,Goodhue,Quirmbach,Vegge,Wirth. Voting
nay: Hoffinan. Motion declared carried.
Moved by Cross, seconded by Goodhue,to direct staff to contact the State of Iowa to ascertain
if a decision had been made on whether the State Nursery would remain at its present location.
Vote on Motion: 6-0. Motion declared carried unanimously.
