HomeMy WebLinkAboutA001 - Council Action Form dated July 23, 2002 ' Yk Item # Date: July A 2002 01�_ COUN CIL ACTION FORM SUBJECT: ESTABLISHING HEARING DATES FOR VACATION AND SALE OF SOUTH 120' OF ALLEY RIGHT-OF-WAY IN BLOCK 1 BLACKS ADDITION, AMES, IOWA (NORTH/SOUTH ALLEY BETWEEN DUFF AVENUE, SOUTH SHERMAN AVENUE, LINCOLN WAY, AND SOUTH SECOND STREET) BACKGROUND: The owner of the property west of Duff Avenue and north of South Second Street has requested that some of the alley right-of-way in Block 1 Blacks Addition, Ames, Iowa be vacated and sold to them. The attached letter details the request and the plat map shows the amount of right-of-way that would be transferred. McDonald's have indicated that they feel the fair market value of the alley is $9,000. According to City policy for disposing of City right-of-way, the adjusted value of this 2,400 square feet of alley right-of-way is $20,984.40. This value is determined by taking the value of the adjacent property and as per City policy, deducting 10% for quit claim deed and deducting 15% for maintaining easements on the property. ALTERNATIVES: 1. Establish August 13, 2002 as the date of public hearing to vacate the alley right- of-way in Block 1 Blacks Addition, Ames, Iowa. Staff also recommends that City Council approve a resolution proposing to sell the property to the abutting owners for $20,984.40 and establish August 13, 2002 as the date of public hearing on the resolution to sell the property. 2. Establish August 13, 2002 as the date of public hearing to vacate the alley right- of-way in Block 1 Blacks Addition, Ames, Iowa. Staff also recommends that City Council approve a resolution proposing to sell the property to the abutting owners for some other value, and establish August 13, 2002 as the date of public hearing on the resolution to sell the property. 3. Do not vacate the alley right-of-way in Block 1 Blacks Addition, Ames, Iowa. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council establish August 13, 2002 as the date of public hearing to vacate the alley right-of-way in Block 1 Blacks Addition, Ames, Iowa. Staff also recommends that City Council approve a resolution proposing to sell the property to the abutting owners for $20,984.40 and establish August 13, 2002 as the date of public hearing on the resolution to sell the property. MN 55431-1442 952/884-4355 Fax:9521885-4755 June 18, 2002 VIA OVERNIGHT MAIL Mayor Ted Tedesco&City Council Members 515 Clark Avenue Ames, IA 50010 Subject: Request for a partial alley vacation for the McDonald's restaurant located on Duff Avenue, Ames, IA Dear Mayor Tedesco&City Council Members, McDonald's Corporation and the Dasher Management group are very delighted to have served the Ames community for the past 31 years. During that period of time,we feel we have been good corporate citizens to the city,the University and a number of worthwhile organizations in the Ames marketplace. We are in the process of renewing our commitment by planning to re-develop our store located at 123 South Duff Avenue and replacing it with the most modern and efficient restaurant McDonald's has to offer.Our hope is to be under construction by October of 2002 with the new facility opened in either late December or early January of 2003 (weather permitting). It is with that goal in mind that we are seeking the help of the city. Enclosed you will find a current survey(marked exhibit"A")this shows the McDonald's site lots 9, 10, 11, 12 and our most recent acquisition of lot 13 from Taco Bell of Iowa. This acquisition allows us to reposition our building and rectify a public safety issue. Currently our drive-through capacity is sufficient for non-peak business times but during our busier operations hours it has caused some back-up onto South Duff Avenue.The new store plan that both McDonald's and city planner,Eric Jensen,prefer(marked exhibit"B")will allow us to eliminate our drive-through problems on South Duff.The other advantage to this plan is that we will be able to remove one of the curb cuts that currently exist on South Duff. In order to accomplish this we need to vacate that portion of the alleyway that runs along lots 9 & 10 approximately 120 feet by 20 feet wide.This vacation of this north/south alleyway will not effect our neighbors as they have an alley that runs east and west from South Duff to Sherman Avenues. If you agree with us that this is a much better plan than currently exists and are willing to move forward on the vacation of the alley we would propose that this property be valued no higher than our current parking area on lots 9& 10. In discussing the valuation process with Mr.Paul Wiegand we will be required to provide the city an easement for the storm sewer which we agree to doing. We believe a fair market value price to be no higher than$9,000.00. McDonald's commitment is to be the best quick service restaurant in the world,one customer at a time.
