HomeMy WebLinkAboutA002 - Council Action form dated July 23, 2002 ITEM # DATE 07/23/02 COUNCIL ACTION FORM SUBJECT: MOTION TO APPROVE A TEXT AMENDMENT TO THE ZONING ORDINANCE TO ALLOW AN EXCEPTION TO THE FRONT YARD PARKING PROHIBITION FOR SINGLE-FAMILY RESIDENTIAL UNITS WITH ONE-CAR ATTACHED GARAGES. BACKGROUND: Through the administration of the Zoning Ordinance, staff has identified a provision which used to be in the previous Ordinance that we believe was inadvertently omitted from the current Zoning Ordinance when it was adopted in May, 2000. The previous Ordinance, Section 29.43(3), and the current Ordinance, Section 29.406(7)(c), prohibited parking in the front yard (the area between the building and the front property line) for residential uses in residential zoning districts. The previous Ordinance, however, had an exception for single-family residential uses with one-car attached garages where there was insufficient room to provide an additional parking pad between the attached garage and the side property line (see attached example). That provision was as follows: "One parking space is permitted in the front yard in the case where there is an existing, one car attached garage and there is insufficient room between the side of the attached garage and the side property line. Such space shall meet the following requirements: (i) The parking space shall not exceed nine (9) feet in width; (ii) The parking space shall be contiguous to and parallel to the existing driveway; and, (iii) The parking space shall be located between the existing driveway and the side property line." The reason for allowing such an exception was the belief that in this day in age, most households have more than one car. Having the ability to park two vehicles off of the street is advantageous to not only the property owners, but also the neighboring property owners as the amount of on-street parking in neighborhoods is usually limited. Staff believes that the omission of this provision from the current Zoning Ordinance was unintentional and believes that this provision should be placed back in the regulations. RECOMMENDATION OF THE PLANNING & ZONING COMMISSION: The Planning and Zoning Commission reviewed the proposed text amendments to the Zoning Ordinance at their meeting of July 3, 2002 and approval was recommended. ALTERNATIVES: 1. The City Council can approve the text amendment to the Zoning Ordinance reinstating the exception to the front yard parking prohibition for single-family detached dwellings, with one car attached garages, and insufficient room to provide parking in the side yard. 2. The City Council can deny approval of the text amendment to the Zoning Ordinance reinstating the exception to the front yard parking prohibition for single-family detached dwellings, with one car attached garages, and insufficient room to provide parking in the side yard. 3. The City Council can approve the text amendment to the Zoning Ordinance reinstating the exception to the front yard parking prohibition for single-family detached dwellings, with one car attached garages, and insufficient room to provide parking in the side yard, with modifications. 4. The City Council can refer the text amendment to the Zoning Ordinance back to staff for further review and comment. MANAGER'S RECOMMENDED ACTION: It is recommended that Alternative #1 be adopted. Alternative #1 is approval of the text amendment to the Zoning Ordinance reinstating the exception to the front yard parking prohibition for single-family detached dwellings, with one car attached garages, and insufficient room to provide parking in the side yard.
