AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF
AMES, IOWA, BY REPEALING SUBSECTION 29.201(160) AND TABLE
29.406(2) AND RE-ENACTING THE SAME FOR THE PURPOSE OF
ADOPTING MINIMUM OFF-STREET PARKING REQUIREMENTS FOR SIT-
DOWN RESTAURANTS; REPEALING ANY AND ALL ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT TO THE EXTENT OF SUCH
CONFLICT; PROVIDING A PENALTY; AND ESTABLISHING AN
EFFECTIVE DATE.
BE IT ENACTED,by the City Council for the City of Ames,Iowa,that:
Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by
repealing Subsection 29.201(160)and Table 29.406(2)and re-enacting the same as follows:
"29.201
(160) Restaurant
(a) Fast Food Restaurant means an establishment which is maintained,
operated,and/or advertised to the public as a place where food and beverage are served to customers
from a serving counter in disposable containers or wrappers and where food and meals are generally
prepared in advance for immediate sale,and which may include inside seating,drive-through service,
delivery service,and takeout/carry-out service.
(b) Sit-Down Restaurant means a use engaged in the preparation and sale of
food and beverages, which could include the sale of alcoholic beverages when conducted as a
secondary feature of the use. The food and beverage is generally for the consumption on-site,
however,may include limited carry-our service.

Section Two. Violation of the provisions of this ordinance shall constitute a municipal infraction punishable
as set out in Section 1.9 of this Code.
Section Three. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of
such conflict,if any.
Section Four. This ordinance shall be in full force and effect from and after its passage and publication as
required by law.
