HomeMy WebLinkAboutA001 - Council Action Form dated March 26, 2002 q � Z�d I ITEM # "A ® DATE 03/26/02 COUNCIL ACTION FORM SUBJECT: MOTION TO APPROVE A TEXT AMENDMENT TO THE ZONING ORDINANCE AMENDING THE REGULATIONS REGARDING SETBACKS FOR COUNTRY HOUSE, CORNER LOTS IN THE "F-VR" VILLAGE RESIDENTIAL DISTRICT. BACKGROUND: Since the approval of the Somerset Village Development, staff has had some limited difficulty administering setbacks on corner lots in the Country House area. The required setback from the rear lot line for attached garages is 20 feet. Originally when the Agreement for Rezoning, Platting and Development of Somerset Subdivision was approved, that distance was 30 feet. The Second Amendment to the Agreement for Rezoning, Platting and Development of Somerset Subdivision (Approved March 23, 1999) changed the rear yard setback dimension for corner lots in the Country House area from 30 feet to 20 feet. This change was administered because the 30-foot requirement made it difficult for some houses to fit onto the lots. Recently, staff has reviewed a request that would involve the construction of a new home on a corner lot in the Country House area of Somerset. The proposed house would be located on the front build-to line, with an attached garage accessed from the side street. The lot is only 100 feet in depth and once a 20 foot rear yard setback and 20 foot mandatory build-to line is applied to the lot, there is only 60 feet of depth remaining for a house. This makes it difficult for a home with an attached garage that is accessed from the side street because those houses are typically longer than 60 feet. Furthermore, when reviewing these regulations, staff noted that in the rest of the City the Zoning Ordinance allows corner lots to have two front yard setbacks and two side yard setbacks. Staff believes that it is inconsistent to have a much more restrictive standard in the village developments where we are actually trying to allow increased density with buildings built closer together. Therefore, staff is proposing to change the rear yard setback on corner lots in the Country House area of village developments from 20 feet to five feet. Five feet is consistent with the side yard setback requirement from the interior lot line. The Fifth Amendment to the Agreement for Rezoning, Platting and Development of Somerset Subdivision (Approved August 22, 2000) required that the placement of buildings in the Somerset Village Development now be regulated by the "F-VR" Village Residential Zone in the Zoning Ordinance and not the Agreement for Rezoning, Platting and Development of Somerset Subdivision. Staff noted, when reviewing the "F-VR" Village Residential regulations, that the rear yard setback requirement for attached garages on corner lots was omitted from the table for Country Houses. Where no alley exists a detached garage may be located a minimum of 3 feet from the rear yard lot lines. • Attached and detached garages shall be located no closer than 5 feet to a side lot line for an interior lot and 20 feet from the side lot line in a norner oonrditien • Attached and Detached garages with access from a street shall be set back 20 feet from the property line adjacent to that street. • Attached garages with access from a street shall be set back a minimum of 5 feet from the rear lot line. • Country Houses shall be located no closer than 5 feet to an interior side lot line and 20 feet to the side lot line in a corner condition in the Neighborhood Edge, and 18 feet to the side lot line in a corner condition in the Neighborhood General. The items that are stricken-through are clarified by the first new bullet which dictates that attached and detached garages with access from a street shall be set back 20 feet from the property line adjacent to that street. These changes are proposed to make the regulations easier to read and understand. The second new bullet is the requirement for a minimum five-foot setback from the rear lot line for attached garages. A visual representation of these regulations is attached at the end of this Action Form. 2 RECOMMENDATION OF THE PLANNING & ZONING COMMISSION: The Planning & Zoning Commission reviewed these proposed changes to the Zoning Ordinance at their meeting of February 20, 2002 and approval was recommended. ALTERNATIVES: 1. The City Council can approve the recommended text amendments to the Zoning Ordinance regarding setbacks for Country House, corner lots in the "F-VR" Village Residential District. 2. The City Council can deny the recommended text amendments to the Zoning Ordinance regarding setbacks for Country House, corner lots in the "F-VR" Village Residential District. 3. The City Council can approve the recommended text amendments to the Zoning Ordinance regarding setbacks for Country House, corner lots in the "F-VR" Village Residential District. 4. The City Council can refer the recommended text amendments to the Zoning Ordinance regarding setbacks for Country House, corner lots in the "F-VR" Village Residential District back to staff for further review and comment. MANAGER'S RECOMMENDED ACTION: Staff believes that the proposed amendments to the Country House regulations in the "F-VR" Village Residential zone will allow for easier and clearer administration of the law. Therefore, it is recommended that Alternative #1 be adopted. Alternative #1 recommends that the text amendments to the Zoning Ordinance regarding setbacks for Country House, corner lots in the "F-VR" Village Residential District.
