HomeMy WebLinkAboutA001 - Council Action Form dated January 8, 2002 Item# DATE COUNCIL ACTION FORM SUBJECT: ORDINANCE TO REPEAL REQUIREMENTS FOR STATEMENT OF REPRESENTATIVE COMPUTATIONS OF SANITARY SEWER RATES AS APPENDIX TO AMES MUNICIPAL CODE. BACKGROUND: The provisions of Subsection 28.304(11) of the Municipal Code, requiring that representative computations for sewer rates be set out as Appendix M to the Municipal Code,was enacted on June 14, 1988,to meet requirements of the Iowa Department of National Resources. A copy of that ordinance, and the first"Appendix M"is attached. Staff has determined that it is no longer necessary to have the statement of representative computations. ALTERNATIVES: 1. Delete the requirement for a statement of representative computations for sanitary sewer rates. 2. Continue to prepare and promulgate the statement of representative computations. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #l. That action will save the City staff the time of preparing an appendix to the municipal Code that it no longer deems to be necessary. COUNCIL ACTION: CAF-Deleting reference to Appendix M,122701.wpd A i ORDINANCE NO. 3013 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA BY ADDING THERETO NEW SUB- SECTIONS 28.39(9) AND 28.39(10) FOR THE PURPOSE OF ADDING A REFERENCE TO FEDERAL REGULATIONS AND SAMPLE RATE SETTING COMPUTATIONS TO MEET REQUIRE- MENTS OF THE IOWA DEPARTMENT OF NATURAL RESOURCES. BE IT ORDAINED, by the City Council of the City of Ames, Iowa: Section One. The Municipal Code of the City of Ames, Iowa shall be, and the same is hereby amended by adding thereto new sub-sections 28.39(9) and 28.39(10) as follows: (9) The user charge ordinance shall take precedence over any terms or conditions of agreements of contracts which are inconsistent with the requirements of Section 204(b)(1)(A) of the Act and 40 CFR Part 35 dated February 17, 1984. (10) The sewer rates established and stated herein are deter- mined by the system for development of proportional user charges set out, with representative computations, as Appendix M to the Ames Municipal Code. Section Two. The representative computations attached hereto are hereby adopted as Appendix M to the Ames Municipal Code. Section Three. This ordinance shall be in full force and effect from and after its passage and publication as required by law.
