The precincts must be defined in an ordinance. After the precincts are established, it is the "' } council's responsibility to amend the ordinance if it is necessary or desirable'to change the precincts. If there are areas in"the city where substantial growth isg anticipated in the next ten years, you may wish to establish precincts with populations significantly smaller than the 3,500 maximum allowed bylaw. As soon as possible after the bill redrawing congressional and legislative districts becomes law the city council shall make the necessary changes to the city's precinct boundaries. [49.7] Saturday, September 1, 2001. City plans must be postmarked on or before today for ;D aH-1- submission to the Secretary of State, unless the legislative redistricting plan does not become law until on or after July 3, 2001. Before final adoption of any change in precinct boundaries, the commissioner (the county auditor) must have the opportunity to review the plan. The council is required by law to permit the auditor not less than seven or more than ten days to offer comments. [49.5] Public hearing. The ordinance must describe the precinct boundaries. Use street names, political boundaries, names of rivers and streams to describe boundaries. Do not use the names of housing subdivisions, or range and section lines. [49.5 and 372.13(7)] Submit to Secretary of State. The plan approved by the City Council shall be submitted to the Secretary of State for approval. If the plan does not meet the standards of Iowa Code section 49.3 and 372.13(7), the Secretary of State shall reject the plan. If there is enough time before the September 1'deadline, the plan will be returned to the city for revision. Otherwise the Secretary of State will redraw the plan and may assess the cost to the city. [49.7] Publication. The City Council shall publish notice of changes in the city precinct boundaries in a newspaper of general circulation published ' the nce each week for three consecutive weeks. The series of publications shall be mad=three a changes in the precincts.have been approved by the Secretary of State. The last publications ,, be made no later than thirty days before the next general election (November 5, 2002�. A map showing the new boundaries may be used. No publication is necessary if no ch riges were made. [49.11] Changes after January 15, 2002. Precinct boundaries are considered permanent until after the next federal decennial census. Changes cannot be made, except for a limited number of reasons: [49.8 & 49.11] ► Annexations. The council must revise the ordinance establishing precincts to include the annexed territory and to assign the annexed area to a precinct. The' requirements of Iowa Code sections 49.3 and 49.5 apply to revisions in precinct boundaries. [49.8(2)] ► Special census. A city may have one special federal census taken each decade and the population figures obtained may be used to revise precinct boundaries in accordance with the requirements of sections 49.3 and 49.5. [49.8(3)] ► Change in form of government. When a city is changing its form of government from one which has council members elected at large to one which has council members electedfrom ,om wards or is changing its number of council members elected g g from wards,the city council may redraw the precinct boundaries in accordance'"`. with sections 49.3 and 49.5 to coincide with the new ward boundaries. [49.8(5)] ► Amend ordinance. Changes in precincts and wards require changes in the affected ordinances. ► File changes. Changes must be filed with the Secretary of State as soon as possible. The changes must also be filed with the County Auditor. [49.7] Polling places. It is the responsibility of the County Auditor to designate a polling place for every precinct. The precincts must be defined in an ordinance. After the precincts are established, it is the council I s responsibility to amend the ordinance if it is necessary or desirable to change the precincts. The council may also divide the city into wards by adopting an ordinance. [49.3, ' 49.5 & 372.13(7)] After each federal decennial census the council must review the precinct and ward boundaries to be sure that they meet the current legal requirements and determine whether changes are needed. [49.7] Cities NOT required to file. Cities 2000 and under. Any city with a population of 2000 or fewer people is considered to be a part of the same precinct as the surrounding unincorporated township, unless the county board of supervisors takes contrary action. [49.4] Cities 3,500 and under, if the city has only one precinct. Any city that has only one precinct does not need to file. [49.3] Cities required to file. The city councils of all cities with more than one precinct, and cities with population of greater than 3,5002 or more must review all precinct (and ward boundaries, if any) to see whether the existing boundaries comply with current laws. Use the enclosed worksheet and the Code of Iowa to determine whether you must make changes. If changes are necessary, the worksheet will provide you with instructions to make revisions. Even if no changes are made, file the completed worksheet and the supporting maps and certifications requested.
