HomeMy WebLinkAboutA002 - Council Action Form dated September 25, 2001 ITEM # DATE 09/25/01 COUNCIL ACTION FORM SUBJECT: MOTION TO APPROVE THE REZONING OF PROPERTY, LOCATED AT 2919 BLOOMINGTON ROAD, FROM FS-RL (SUBURBAN RESIDENTIAL LOW DENSITY) TO FS-RM (SUBURBAN RESIDENTIAL MEDIUM DENSITY). BACKGROUND: The subject area under rezoning consideration is located at 2919 Bloomington Road (see attachment titled "Location Map"). The applicant is requesting to move the FS-RM zoning boundary on the parcel north to accommodate an additional apartment complex that is planned for the site (see attached "Proposed Zoning" and "Apartment Concept Drawing"). Moving the boundary north is necessary to accommodate the parking that would be associated with the proposed structure. The request will also necessitate the omission of two attached single-family lots (Lots 412 and 423) as shown on the Uthe Farms Subdivision Preliminary Plat dated August 28, 2000 (see attached "Preliminary Plat"). ANALYSIS. Land Use. Presently the land area to the north, east, and west of the subject area is vacant. The properties south of the subject area are single-family homes (Northridge Subdivision) and agricultural land (Taylor Farm north of the Somerset Subdivision). Zoning. The request represents moving the FS-RM zoning boundary on 2919 Bloomington Road 50-feet to the north. The change will assure future zoning conformance for the existing and proposed multifamily structure when the area is replatted (see attachment titled "Zone Correction Map"). The properties south of the subject property are zoned Residential Low Density (Northridge) and Agricultural (Taylor Farm north of the Somerset Subdivision). The properties to the north and west of the subject area are zoned FS-RL, and property east of the subject property is zoned FS-RM (see attachment title "Existing Zoning"). Land Use Policy Plan (LUPP) Goals and Policies. The change in the zoning boundary does not significantly change the designation of uses shown on the master plan of the Northridge Heights Subdivision. The movement of the zoning boundary and addition of another multifamily structure will provide for a slight increase in traffic and will require the omission of two single-family attached lots. The omission of these two lots will decrease the density of the area zoned FS-RL. However, these changes are in conformance with the density requirement of 3.75 for the FS-RL zoned area as outlined in the City's Zoning Ordinance (Table 29.1202(6), Page 29-120). Furthermore, the changes are consistent with the location and density goals stated in the City's Land Use Policy Plan (LUPP, Pages 38 & 62). The proposed multifamily structure will be located along a major thoroughfare (LUPP, Page 63) and located on a site that currently exists as a multifamily use that was designated as multifamily in the master plan for the subdivision (see attached "Master Plan"). RECOMMENDATION OF THE PLANNING & ZONING COMMISSION: The Planning and Zoning Commission reviewed this rezoning request at their meeting of September 5, 2001 and approval was recommended. ALTERNATIVES: 1. The City Council can approve the rezoning of a 50-foot strip of property located at 2919 Bloomington Road from "FS-RL" (Suburban Residential Low Density) to "FS-RM" (Suburban Residential Medium Density). 2. The City Council can deny the rezoning of a 50-foot strip of property located at 2919 Bloomington Road from "FS-RL" (Suburban Residential Low Density) to "FS-RM" (Suburban Residential Medium Density). 3. Action on this request can be postponed and referred back to City staff and/or the applicant for additional information. RECOMMENDED ACTION: It is recommended that Alternative #1 be adopted. This is a recommendation to rezone a 50-foot strip of property located at 2919 Bloomington Road from "FS-RL" (Suburban Residential Low Density) to "FS-RM" (Suburban Residential Medium Density).
