HomeMy WebLinkAbout~Master - Zoning for Independent Senior Living Facility ORDINANCE NO.3622 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA, BY REPEALING SUBSECTIONS 29.406(2) AND 29.1202(4) AND ENACTING NEW SUBSECTIONS 29.201(92A), 29.406(2), AND 29.1202(4) FOR THE PURPOSE OF AMENDING ZONING REGULATIONS FOR`INDEPENDENT SENIOR LIVING FACILITY';REPEALING ANY AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT TO THE EXTENT OF SUCH CONFLICT; PROVIDING A PENALTY; AND ESTABLISHING AN EFFECTIVE DATE. BE IT ENACTED,by the City Council for the City of Ames,Iowa,that: Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by repealing Subsections 29.406(2)and 29.1202(4)and enacting new Subsections as follows: "Sec.29.201. DEFINITIONS. (92A) Independent Senior Living Facility means an apartment dwelling featuring a central lobby, common dining area,and recreational rooms exclusively for the tenants. Domiciliary care services exclusively for the tenants may also be provided. Accessory support uses exclusively for tenants,such as pharmacies,banking services,barbers/beauticians,etc.may be included. The occupancy of an independent senior living facility shall be limited to: (a) Persons of the age of 55 or greater;or (b) `Handicapped'but not including those persons currently illegally using or addicted to a`controlled substance' as defined in the Controlled Substances Act 21 U.S.C. Section 802(6). Sec. 29.406(2). Required Parking Spaces. Off-street parking spaces must be provided in accordance with the minimum requirements set forth in Table 29.406(2)below,for any new building constructed and for any new use established. (a) The off-street parking space requirement for a use not specifically mentioned herein is the same as required for a use of similar nature. (b) Whenever a building erected or established after the effective date of this Section is enlarged in floor area,number of employees,number of dwelling units,seating capacity or otherwise to create a need for an increase of 10%or more in the number of existing parking spaces,such spaces shall be provided on the basis of such enlargement or change. (c) Whenever a building existing prior to the effective date of this Section is enlarged to the extent of 50%or more in the floor area,said building or use shall then and thereafter comply with the parking requirements set forth herein. Violation of the provisions of this ordinance shall constitute a municipal infraction punishable as set out in Section 1.9 of this Code. Section Three. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict,if any. Section Four.
