ces- '-)db pl � r"L. t)Ca.v-/ VT 3 ITEM # �3 Q - C DATE 03/27/01 COUNCIL ACTION FORM SUBJECT: MOTION DETERMINING THAT THE REQUEST FOR DESIGNATION OF URBAN REVITALIZATION AREA FOR 511 SOUTH FOURTH STREET MEETS THE CRITERIA FOR ELIGIBILITY UNDER THE MULTIPLE FAMILY RESIDENTIAL CRITERIA MATRIX AND TO PROCEED WITH SETTING THE DATE OF PUBLIC HEARING. BACKGROUND: On February 6, 2001 the City of Ames received a Request for Designation of Urban Revitalization Area for property located at 511 South Fourth Street. The request was denied, as the property did not meet the Slum and Blighted or Underutilized Conditions in the Required section of the Multiple Family Residential Criteria Matrix. The applicant, on February 26, 2001, requested that the City Council reconsider the action taken on February 6. The City Council on February 27, 2001 directed staff to have the applicant reapply, if applicable, for Designation as an Urban Revitalization Area. Staff, in developing the Slum and Blighted requirement, had made a determination that the property had to be found substantially unsafe to be classified as Slum and Blighted. The property at 511 South 4t" Street was determined to be a safe structure in the initial application. Staff reviewer' `',-ie process to determine a safe or unsafe condition after the City Council meeting of February 27, 2001 and decided that a more concise method of determination was needed. In the old process the Inspections Division visits the property and prepares a checklist of unsafe conditions based on the Dangerous Building section of the City of Ames Municipal Code Sec. 5.131. The Inspections Division then reviews the checklist and makes a determination of whether the property is safe or unsafe and makes their recommendation to the City Council. Staff reviewed the checklist process and identified a weakness in the process. To..make the process less subjective staff has developed a process to quantify the checklist in order to make a determination of safe or unsafe for the Urban Revitalization Program The new process quantifies the checklist to a cost estimate to repair the unsafe conditions. If the property is found to have a condition under the Dangerous Building section, then the Building Inspections Division determines the cost of repairing that particular condition. These costs are determined from two sources, The Nations Construction Estimator and RS Means Square Foot Costs. These publications give regional cost estimates for construction and repair work. Once all of the conditions are given repair cost estimates, the costs are totaled. I If the total costs are more than 70% of the assessed value of the structure, then the structure is determined to be unsafe. The 70% value was chosen as it reflects the number used in the Zoning Ordinance to determine if a nonconforming structure can be rebuilt or not, which has already been determined by the City Council as an acceptable policy. Under this new procedure, of the determination of a substantially unsafe building, the structure at 511 South Fourth Street was found to have unsafe item repair costs of $60,980. The assessed value of the structure is $79,000. This makes the repair costs 77% of the assessed value of the structure. Under the new guidelines for determining safe or unsafe conditions of a building for the Urban Revitalization Program, the property at 511 South Fourth Street is classified as unsafe. (See attached checklist). This property has an approved site plan for a 3-story, 16-unit apartment building of wood and masonry construction, with 26 parking spaces being provided, to be constructed on 2 lots. Currently there is a vacant house on the property. The action to be taken by the City Council is to determine if the request meets the Criteria for Eligibility under the Urban Revitalization Multiple Family Residential Criteria Matrix. If the City Council determines that it does, then to set a date of Public Hearing for approval of the Request for Designation of Urban Revitalization Area for 511 South Fourth Street. ANALYSIS: The applicants have submitted a Request for Designation of Urban Revitalization Area for 511 South Fourth Street under the Multiple Family Residential Criteria Matrix (see attached request and letter). Staff has determined that the request is complete and the information submitted is correct. The applicant indicates that there is one vacant house on the premises, which is to be removed, and that the properties of 511 South Fourth Street and 319 South Walnut Avenue are to be combined to create 511 South Fourth Street. The house is vacant but has not been removed. The addresses of the properties to be included in the Urban Revitalization Area are 511 South Fourth Street and 325 South Walnut Avenue. The property at 325 South Walnut Avenue is being included to meet the requirement under state law that there are at least two structures in each Urban Revitalization Area. The property at 325 South Walnut will not receive any of the tax benefits of the program, as the Urban Revitalization Area will be stated as specifically pertaining to the project at 511 South Fourth Street. Thy total current assessment is $138,700 for the two properties. The value of the land only at 319 South Walnut is $30,800, the 511 South 4tn Street building value is $79,000 and the land value is $28,900. The total tax revenue for the two properties currently is $5,664. The estimated cost of the new apartment building is $900,000. The estimated future tax revenue without abatement would be $24,227.68 per year. The following analysis is from the building value estimated by the property owner and the established land value by the City of Ames. The tax rate is the current tax rate, no change is taken into consideration over a 10 year period on the value of the property and the rate of taxes. 2 The taxes deferred and collected analyzing the three different tax schedules are listed below based on the following valuation: Estimated value $ 900,000 Tax rate/$1,000 Valuation = $29.50996 Land Value $ 59,700 Total Value $ 959,700 Yearly tax revenue: $24,227.68 Existing Value $ 138,700 Taxable Value $ 821,000 No tax exemption over a ten year period = $242,276.80 Taxes Exempted Per Taxes Paid Over 10-Year Schedule Period 3-Year: $ 72,683.04 $169,593.76 5-Year: $ 72,683.04 $169,593.76 10-Year: $106,601.79 $135,675.01 Required Conditions The Criteria for Eligibility under the Multiple Family Residential Criteria Matrix (see attached), mandates that the property must display one of two required conditions before it can be determined that the property is eligible to be considered further. These two threshold conditions are: - A slum and blighted condition, or - An underutilized condition. The applicant has indicated that the site is slum and blighted in its present condition. For the Slum and Blighted portion of the Criteria Matrix the property must meet the following: - Properties where a majority of the assessed valuation of the properties has been determined to be substantially unsafe or to have an unsafe use by the City Council. It is staffs' belief, using the revised method of determination, that the applicants' request does meet the Slum and Blighted requirement (see the attached review by the City Inspections Department). The applicant has submitted cost estimates for repair of the building. These cost estimates were not taken into consideration when determining the safe or unsafe condition of the building. To be consistent, staff will refer to the construction standards described earlier for determination of a safe or unsafe condition and not the estimates provided by individual property owners. The applicant indicates that since one structure has been removed and the existing structure is a four-plex in a RH zoning area, that the property is underutilized. To be considered underutilized the property has to be vacant. One of the principal buildings has been removed but a four-plex remains on the property. A four-plex is an allowable use in the RH Zoning District. Therefore staff believes this property does not meet the Underutilized Requirement under the Urban Revitalization Multiple Family Residential Criteria Matrix. Since the applicant has met the required conditions, staff has analyzed the Optional Conditions. The applicant has selected the following Optional Conditions: "Brick or Similar Masonry Material" and "Landscaping Beyond Required". Staffs analysis of the request with respect to these Optional Conditions follows. Optional Conditions Under the optional requirements of the Multiple Family Residential Criteria Matrix these are the two options selected by the Applicant: - Brick Construction or Similar Masonry Material: 100% of the street face and 50% of the sides of the structure shall be faced with brick or similar masonry material; and - Landscaping Beyond Required: Landscaping improvements installed at 150% of the required landscaping standard or greater. The applicant has an approved site plan (see attached exterior plan) and has designed the apartment building with brick construction on 100% of the street face and at least 50% of the sides of the structure The landscaping requirement of 150% of the required is exceeded, as the landscaping provided is 278% of that required under the Zoning Ordinance (see attached landscape plan). The landscaping requirement under the Zoning Ordinance is 1 landscaping unit for every 60 feet of frontage along a public street. This property would be required to have 2.25 units of landscaping. The design has the following landscaping units: 4 over story trees 4.00 units 27 shrubs 2.25 units Total landscaping 6.25 units The landscaping exceeds the Zoning Ordinance landscaping requirements by 278%. Based on this analysis it is staffs' conclusion that this request meets the optional conditions of "Brick or Similar Masonry Material" and "Landscaping Beyond Required". Staff has determined that the applicant has met the required Slum and Blighted criteria (Properties where a majority of the assessed valuation of the properties has 4 been determined to be substantially unsafe or to have an unsafe use by the City Council.) for the Multiple Family Residential Criteria Matrix. Staff has also determined that the applicant has not met the required Underutilized Condition criteria (Properties that are non-conforming with respect to the base zone must be brought into conformance.) for the Multiple Family Residential Criteria Matrix. Staff has determined that the project does meet the optional conditions ("Brick or Similar Masonry Material" and "Landscaping Beyond Required "). It is staffs' belief that the request meets the required condition, therefore it is recommended that this request be approved. Further, the proposal should proceed to the next step in the process, which would be to set a date of public hearing for the approval of the Request for Designation of Urban Revitalization Area for 511 South Fourth Street. ALTERNATIVES: 1. The City Council can determine that the Request for Designation of Urban Revitalization Area for 511 South_F treet meets the criteria for eligibility and to set a date of public hearing for: May 8, 2001. 2. The City Council can determine that the Request for Designation of Urban Revitalization Area for 511 South Fourth Street does not meet the criteria for eligibility. 3. The City Council can refer this request back to staff for additional information. MANAGER'S RECOMMENDED ACTION: After reviewing the process to determine the safe or unsafe condition of buildings for the Urban Revitalization Program, staff has developed a system that directly relates the cost of repair of unsafe conditions to the value of the building. This process reflects percentages that are currently used in the Zoning Ordinance for nonconforming determination. This system can be administered equally for each property brought forward under the Urban Revitalization Program for determination of a slum or blighted condition. Under this new system it has been determined that the property meets the Required Condition of"Slum and Blighted" and that the property also meets the Optional Conditions of"Brick or Similar Masonry Material" and "Landscaping Beyond Required" for the Multiple Family Residential Criteria Matrix. It is the recommendation of the City Manager that the City Council adopt Alternative #1. This action will approve the Request for Designation of Urban Revitalization Area for 511 South Fourth Street and set a date of public hearing for May 8, 2001. For all standards with a yes, the dollar amounts for repairs are determined by a published estimating guide. Dangerous Building Defined. For the purpose of this code, any building or structure which has any or all of the conditions or defects hereinafter described shall be deemed to be a dangerous building, provided that such conditions or defects exist to the extent that the life, health, property or safety of the public or its occupants are endangered: (a) Whenever any door, aisle, passageway, stairway or other means of exit is not of sufficient width or size or is not so arranged as to provide safe and adequate means of exit in case of fire or panic. (a) If yes, (b) Whenever the walking surface of any aisle, passageway, stairway or other means of exit is so warped, worn, loose, torn or otherwise unsafe as to not provide safe and adequate means of exit in case of fire or panic. Walnut and 511 S. 4th Street for which we would like to have an urban revitalization area designation. In reviewing the criteria matrix for the Multiple Family Residential Urban Revitalization Program worksheet we feel our property falls under both the underutilized and the slum and blighted criteria. When the whole neighborhood had been identified as a Revitalization area an unlivable single family structure was removed from 317 S. Walnut. 317 S. Walnut comprises 60% of the subject property and this would fit the criteria of"underutilized vacant infill area which previously contained a structure". The other 40% of the property is underutilized in regard to the maximum taxes that could be generated from eight to nine units rather than four units. Under the slum and blighted criteria one issue is the inadequate nature of the neighborhood due to the fact that it contains only structures that were moved in after they were obsolete in their existing neighborhoods. This was the case with 511 S. 4th. Another issue is that while the newer vinyl siding has a good cosmetic appearance, it covers many structural and functional problems that plague the property. The City building inspector visited the property recently and identified the following problems: 1. Structural settling has occurred around the foundation, primarily at the porches and steps. 2. The existing structure is not insulated and would be difficult to completely retrofit. 3. The electrical entrance is substantially undersized and needs to be replaced. 4. The electrical distribution system within the apartments is inadequately sized, not properly grounded, and not evenly distributed as required by code. 5. The existing plumbing system is old galvanized water piping and cast iron waste piping and is subject to leaking and corrosion. 6. The existing heating system is currently working properly, but the furnace has outlived its useful life and is in need of replacement 7. The existing roof has outlived its useful life; two areas of the roof have continuing leaking problems. 8. The lower level apartments suffer frequent flooding due to improper grading of the site. 9. The second floor layout provides a doorway to an unprotected deck, but does not provide a secondary exit from that floor. 10. The existing parking on the site is substandard and does not meet current zoning. While the building inspector identified the parking as substandard neither of us knew at the time of his inspection that further use of the parking has been denied to us. This leaves the property with an expired occupancy permit and an inability to obtain a new one because of a lack of parking. We have obtained estimates to correct most but not all of the deficiencies cited by the building inspector and are including them with this letter. We also have had the property inspected for asbestos and find that there are several suspected asbestos materials in the structure that could cost as much as $5750.00 to remove. The cost for the other repairs to bring this building up to code is $102,279 and the current assessed value of the building is $79,000.00. We are enclosing the actual bids with this letter. We feel this neighborhood was rightly identified for redevelopment in 1984 and because of the difficulty in acquiring suitable sized lots. Only one developer even showed interest to develop under the original program. They did not offer the quality of redevelopment that we are now offering. Since the program has changed there has been no new development of either urban revitalization or conventional development in this neighborhood. We have owned these properties since the middle 1970's and originally purchased 317 S. Walnut only for redevelopment purposes. We do currently meet the underutilization section on 60% of the site. We also feel that we are meeting all of the optional requirements to a large degree: the brick requirement 100%, the landscaping 100% and structured parking 16%. Also, these apartments are offering efficiencies, 1-bedrooms and only two 2- bedrooms for people working in this neighborhood. They will not be oversized, high rent apartments with little parking occupied primarily by students. We have found in renting our other apartments in this area that our 1 bedroom and efficiency apartments are in demand by single working people and professionals who want to be close to downtown. We would like the City Council to grant us urban revitalization as was a longstanding goal in this neighborhood and will give this rather strange neighborhood some quality development with increased long term tax benefits to the City of Ames. Dear Mr. Cooper, As you know asbestos is a known carcinogen and the DNR requires it be removed prior to demolition of"facilities". Your 4 plex qualifies as a facility. My pre inspection observation is that there are several asbestos suspect materials in the structure. The cost to remove this is estimated at $5000.00 should any be asbestos. The cost to inspect is approximately $750.00. If I can be of service please advise.
