While visiting my daughter in California three years ago,they were discussing the same type of ordinance that you folks are about to put on the table.Let me tell you,it wasn't received well by the public then and is not now. How I marvel at how a few well meaning individuals that have positions in government seem to think a change is needed. If an eating establishment wishes to not allow smoking,why not let them post a sign stating this is a smoke free place as some presently do.While others do business as usual.Customers are what makes the cash regester ring and pay the bills.We had a nice restaurant here in Waterloo that went smoke-free a few years ago and nearly went bankrupt.They changed their thinking in a hurry.You are in office to serve all the people. My mother lived to the age of 92 before passing and she was exposed to smoke nearly all her life.So don't try to sell me on second hand smoke health risks.If you want change,let the people vote and decide. We urge the Ames City Council, Please do not pass a ordinance banning smoking in restaurants in the city of Ames. At the present there are several restaurants (65%) in the City that are totally non smoking. This was their business decision. If a diner wishes this environment they have several choices of where to dine. Cyclone Truck Stop Restaurant is different than any of the other restaurants in Ames that allow smoking, as we are not a destination restaurant, that is Ames is not the destination of the customer. We deal almost entirely with the transit trade. These people have the option of which city they wish to stop in. If they are smokers which, if we can believe our figures after a polling of our customers, 71% are, they have the option of stopping at our location and if the ban was in effect, they could not `enjoy' a cigarette after finishing their meal or they could travel 20+more miles to the south or 15 miles to the north and find a restaurant where they could enjoy their break and smoke a cigarette. We started a petition as much for our benefit to learn what the feeling of our customers were as it was to present to the Council and although we were sure that a majority of our customers would prefer that it remain a smoking environment we were amazed at the actual number of Customers who would be opposed to the ban. Most were smokers but several were also non-smokers. We have had 811 people sign our petition and of that number only 29 people were for banning smoking in all restaurants in the City of Ames. This is a percentage opposed to the ban of over 96.4%. Those that wanted the ban only 3.6 %. The reason the non-smokers gave for being against the ban was the infringement on the rights of everyone not just the smoker. We took the time to talk to many of our customers about the banning ordinance something the proponents of this ban have apparently not done. The people that we have had a chance to talk with that were transit and were smokers said they would not stop if they could not relax and smoke no matter how good the service or food was. We did not talk to one person that said that if we did not ban smoking that they would stop trading at our location. Many of our local customers who are smokers indicated that they would not patronize us as often if the ban was in effect. The smoking ban would hurt our business very badly. If the proposed ban was a state wide ban it would not hurt us in central Iowa quite some much, but when the Customer can eat and have a smoke anywhere else in the state of Iowa except for the City of Ames we are put at a economic disadvantage. Food is not the only item that our customers look for when they stop at our location. They are also after gasoline or diesel fuel and possible the items we carry in the convenience store. This means that if we lost 10, 20, or 30 percent of our food business to a smoking ban then we would probably lose 10, 20 or 30 percent of our gasoline or fuel business. To save time this type of customer eats and fuels in one stop. With this type of loss we would not be able to survive. Along with these losses in business is the loss in tax revenue of which the city of Ames would not recoup. Once that customers stops at another city that revenue and tax is lost forever. What ever our personal feelings are about the morality of smoking we should not impose that morality on some one else of legal age. The ban would take a other wise legal activity, smoking, and then making it illegal because they are lighting up in a certain type of privately owned, not a city supported, establishment. It should be the decision of each individual, privately owned establishment, if they wish to have a total smoke free environment. Then the customer has the choice of which restaurant that they wish to patronize, one that is entirely smoke free or one that allows smoking in some areas. If our decision to allow smoking cost us customers and puts us out of business then that is how it should be. To take a position with the ban smoking group may be political correct in this day and era. A few weeks ago I attended a softball tournament at one of the fine ball parks in Ames. This would be a very good place to ban smoking if the banning of smoking is a good social reason or if banning smoking is political correct . Probably more of the young people see smoking and smoke in the local parks then they do at restaurants in Ames. There have been many editorials and letters to the editor in the local paper. The one item that was common in all of these articles was not one of these people have their personal money invested or their living hinging on the success or failure of a private business that depends on satisfying both smokers and non smokers. One of the editorials sited a smoking ban in Madison, Wl. and a study of economic growth of restaurants in Madison that indicated that the ban did not hurt their business. This research was supported by a grant from the Wisconsin Smokeless States Program, certainly a basis organization.. The study was conducted by Laura Dresser, Phd an economist and researcher at the University of Wisconsin-Madison. The study covered all of Dane County not just the city of Madison. The study does not show that revenues grew by 24 percent in Madison as was stated. The research shows that the total growth in Dane County(both the areas where there was a smoking ban and areas where there was not a smoking ban.) was 24 percent. In a conversation with a representative of the Wisconsin Restaurant Association I was told that Dane County along with the City of Madison has had a great economic revival in the last few years and this area has grown at a much greater rate than the rest of the State. This would account for the difference in the growth percentage stated. This research seems to have many flaws and uses opinion and conjecture more that fact. On the first page she states that"due to long-term exposure to secondhand smoke, waitress have four times the national rate of lung cancer". No reference to any factual study,just her opinion. I ask each of our waitress if they smoked. Unfortunately 100 percent do. Although we may wish they did not smoke it is fact not a opinion that they all do. If one of our employees should develop cancer the reason probably will be smoking not exposure to second hand smoke. This research mentioned did not even try to cover up the fact that it was not comparing apples to apples. It was more like apples to toad stools. This same editorial referred to a study conducted by the EPA on environmental tobacco smoke (ETS). This study was a total farce. The federal court's ruled against the EPA on the subject of secondhand tobacco smoke. The EPA's claim that second hand smoke was a significant cause of lung cancer was exposed by a number of journalists at the time it was issued. Now a Federal judge, District Judge William Osteen after considering expert testimony and reviewing the records, has confirmed its phoniness. Osteen accused the agency of"Alice in Wonderland-style justice", in which the verdict comes before the evidence. By the way Osteen was the federal judge that a year earlier had ruled that the Food and Drug Administration has the authority to regulate nicotine levels in cigarettes. He is not in the pocket of the tobacco people. Here is what the Osteen determined that the EPA did. 1. It started with a conclusion. 2. It cherry-picked the studies it would include in its analysis. 3. When even the cherry-picked studies failed to show a statistically significant correlation, it changed its methodology from the standard 95 percent to the 90 percent. 4. Even by the bogus 90 percent standard, the cherry-picked studies showed only a very small risk. 5. It hid from the public, information it was supposed to make available. 6. It lied about why it changed the standard. Even had the EPA not been caught in this lie and we all blindly accepted the study as some apparently do, their study showed that a nonsmoker who lives with a smoking spouses are more likely to be killed in a homicide than they are to die from lung cancer caused by somebody else's smoking. They would also have about the same chance of dying from electrocution or by drowning. To use this study to call Environmental Tobacco Smoke a public health issue is a stretch after finding how the EPA conducted this research. If you still believe this research after carefully reading and studying Judge Osteen ruling, it isn't cigarettes that you are smoking. I have the documentation available on the EPA study and the Madison, WI. study which I will include with this letter. If anyone is interested in learning the truth it would be good to read this report with a open mind. Some would lead you to believe that by banning smoking business will somehow increase. If this is true why do the vast majority of people in the restaurant business favor choosing their own destiny rather than having it legislated by government. That is the reason they call theses people business men and business women not day dreamers. Study after study after study indicates that without a doubt banning smoking will be harmful to the restaurant business. If this ban is passed, I would like to sell or lease to any of the advocates of this ban. Maybe I could learn something from them. If you want a unbiased piece of research about the cost to business after banning smoking, one was done for the Finance Department, City of Mesa, Arizona. I have included this report but some excerpts are as follows. It states: "All but one business in the survey experienced declines in sales after implementing the smoke-free ordinance." "Restaurant sales generally down 25 to 35 percent with the impact closely tied to the value of liquor sales at each establishment." "Bowling alleys down 10 to 20 percent." "Pool halls down 30 to 40 percent." "Hotel bar business down 40 to 50 percent for bars frequented by local residents." "Other establishments down 24 percent." "Hotels and restaurants with banquet facilities have also noticed a decline in this type of business. In some cases, the majority of a group may be non-smokers, but in order to accommodate smokers in the group, people are moving banquets and receptions to facilities in other cities. In most cases these banquets may include 100 to 2000 people, so the loss of three or four bookings during a summer can be significant in terms of dollars lost." "Most businesses reported hearing as many comments, if not more, from non-smokers as from smokers. Smokers are feeling displaced and are complaining about the ordinance being unfair. Many smokers who are regulars at certain establishments have simply stopped coming in. Non-smokers who are more vocal may appreciate the smoke-free environment, but disagree with the ordinance in principle because it doesn't allow people or businesses the freedom to choose. Only a few establishments reported positive comments from non-smokers, primarily from families." It was also indicated in one of the Ames newspaper articles that since we regulate hand washing in a restaurant that it would be natural that we regulate smoking in a restaurant. As a restaurant owner I am charged with where my employees can smoke and that they are to wash their hands before returning to duty. This does not mean that we require the customer to wash their hands. Quite a difference. It never ceases to amaze me the research, the studies or the reasoning that is used to make a point with very little truth of just half truths used. Even though the Ames City Council has the right to pass this ordinance, it is not the right thing to do. My wife and I are frequent visitors to Ames for sporting events and cultural events offered there. In addition, we provided the tuition for two children at IA STATE. First, about myself. I smoked for over 40 years and decided on my own to quit sometime ago. My wife is still a smoker. People make decisions every day that effect their lives. Also, businesses make decisions every day that determine their profitability. Governments should not attempt to legislate people's personal actions. One of your better places to eat, Hickory Park, recently built at a new location and decided to become smoke free. That is their option and their decision and no one will ever complain about that. However, when a government decides to legislate a decision an informed citizen can and should make, I become very concerned. We see it too often today. The choice already exists for those who wish to dine in a non-smoking environment. The choice for others is very close to being taken away. This "Constraining of Rights" proposal may work for the hundreds of cities in California, however, Ames happens to be in the middle of Iowa. I own a business in Iowa and require the use of motels and restaurants in other cities as a significant part of my activities. I can certify that if this absolute-non-smoking ban becomes law; all aspects of my corporation will be forced to look elsewhere - such as Boone, Story City,Nevada, or Des Moines. The drive will be worth it. Ames has some very fine restaurants that I frequent and have gone to in the past. The city council will determine my future options. I realize that I am one opinion. Our business and we as individuals are against this measure. Arbitration between the two sides might be valuable, except that at this point you have failed to give your definition of exactly who this ban will affect. Therefore,you have excluded a portion of those possibly concerned from those closed meetings. This is not a matter to rush. At the last council meeting,one point did stand out. There are those on the board who wish to push this proposal through quickly. This will affect many businesses in town.And it is the duty of the council to seek the advice of citizens of this town and not be misled by a vocal,organized minority. Finally,it is our position that this matter should not be left to city control to start with. In Story County,we have worked at promoting the smaller businesses. The decision to have a non-smoking establishment should be left to the management of each business. Instead of lobbying the city council, those customers wanting a business that they frequent to be smoke free should be bringing their views to the management of that business. When it is monetarily beneficial to that business, management will surely change policy. Isn't that, after all,part of the free enterprise system? Just thought I would pass on what I feel--I realize that smoking might be dangerous for my health but it is my choice to smoke and if you pass this ban in Ames a lot of businesses will lose a lot of business. I will quit bowling in Ames and I have a lot of friends that probably will do the same thing. I will quit going to restaurants and bars in Ames because I won't be able to enjoy myself if I can't smoke.....this will probably be a good thing for my town because I will spend more money and time in my town because it will let me do as I wish.....I do hope this ordinance don't pass but if it does so be it-- -1 will wave at Ames as I drive past and do my shopping either in Des Moines or what ever town will let me be me. I have been a citizen of Ames for 32 years and have enjoyed eating out at its restaurants often. I believe the action which the council took last night was sheer idiocy. They had made up their minds that they were going to do this no matter what the businesses felt or who it might hurt. I have also eaten at establishments that do not allow smoking and I don't think it is a big problem in those instances for me not to smoke, but when I do go to a restaurant where there is smoking allowed, I like to have the choice as to smoking or not. I hope those who were in opposition to this action sue the City for all they can get. I listened with absolute disgust as those who were in favor of the ban acted in such a self righteous, better than thou manner. I would have attended, however after having watched how things turned out, it merely enhanced my feeling that it would not have done any good anyway. The council really didn't want to hear what the opponents had to say. I hope that if the Attorney General's Office issues an opinion in this matter that it will squash the City's efforts to enforce this ban. We have just moved to Ames, and are not smokers,but believe that citizens of Ames are mature enough, and have enough common sense to decide whether or not to visit an establishment that allows smoking. What troubles me even more is when I contacted my city council person, she told me not to worry because the city was going to pass the ordinance, but they would not enforce it. Why spend the tax dollars if you will not or cannot enforce the ordinance? Again, we are new to Ames, and it scares me to think that the City Council would try to control every move made by its citizen in order to secure the reputation of being the first city in Iowa to pass a restaurant nonsmoking law at the expense of the tax payers. I feel that tax dollars would be better spent enforcing laws that are already on the books. The economic effects of the Maine smoking ban (implemented on September 18, 1999) are examined in this siuuy and businesses. State law forbids smoking in restaurants and restaurant bars, but exempts stand-alone bars such as Class A lounges, hotel lounges and taverns that primarily provide liquor sales. Economic Model Predicts That Smoking Bans Impose Adverse Effects on Many Businesses. An economic model is developed that provides testable hypotheses concerning the impact of a smoking ban on patrons and businesses. The model demonstrates that business owners adopt smoking policies that cater to customer preferences and therefore owners do not adopt uniform policies when customer preferences vary with regard to the issue of smoking. A smoking ban mandates the same policy (i.e., no smoking) for all owners and therefore bans are predicted to exert differential effects on businesses which simply means that some will gain, some will lose, and still others will experience no economic effects. Previous Literature Demonstrates that Smokin2 Bans Harm Many Businesses Previous empirical evidence supports the predictions of the economic model. This study contains a comprehensive review of past studies that conclude that smoking bans exert differential effects on businesses. While several studies have been published that conclude that bans do not harm businesses, a thorough assessment of the literature indicates that such claims are unsupported by the economic theory and evidence. These studies are shown to contain critical flaws in their statistical methodologies. Maine Smokers Out-Spend Non-Smokers By Almost Double A comprehensive survey of 1,200 customers of restaurants and restaurant bars in Maine indicates that smokers not only frequent restaurants and restaurant bars more often, they spend more on a per visit basis than do non-smokers. Average weekly spending in restaurants by smokers is $73.28, and for non-smokers it is $51.50— smokers out-spend nonsmokers by roughly 42% in restaurants. Average weekly spending in restaurant bars by smokers is $73.25, and for non-smokers it is $25.22 — smokers outspend non-smokers by roughly a factor of 3 in bars/lounges in restaurants. When tabs for restaurants and restaurant bars are added together, smokers spend $146.53 per week versus $76.72 per week by non- smokers—a factor of almost two. Smoking Ban Adversely Affects Patrons Who Smoke. Data on actual changes in patron behavior indicate the following effects from the smoking ban. ■ Fewer Visits. While most non-smokers (80%) have not lowered visits to restaurants, roughly 40% of smokers ate out less often (average of 60% fewer visits). Approximately one-half of smokers made fewer visits to restaurant bars (average of 60% fewer visits), while up to one-third of non-smokers made more visits (average of 30% more visits). R J • Less Time Dining. Slightly more than one-half of smokers spent less time dining per visit, with average reductions of 46% per visit. Only 22% of non-smokers increased dining time per visit, with an average increase of 26%. ■ Hi2her Purchases of Take-Out Food While most non-smokers did not change their purchases of take-out food, roughly one-third of smokers purchased more take-out food following the ban. The average smokers purchased 45% more take-out food. Maine Businesses Provided a Diverse Set of Smokin2 Policies Prior to the Smoking Ban. An examination of a sample of 45 Maine restaurants indicates that 23% of these businesses provided from 0%-25% of their seating for non-smoking use, 22% provided between 26%-50%, 11% provided between 51%-75%, and 43% provided between 76%- 100%. Ample choices were therefore available for patrons with strong no-smoking preferences, as 15 of 45 (33%) businesses forbid smoking within their establishments. Obviously, businesses did not find it profitable to offer identical smoking policies because they served customer bases with varying preferences toward smoking. Smoking Ban Exerts Adverse Effects on Many Businesses Adverse effects are consistent with the evidence demonstrating that owners serve customer bases with varying smoking preferences. The evidence indicates the following adverse impacts exerted on businesses. } 15% of Restaurants Experience Lower Revenues For restaurants, roughly the same number of businesses realized higher revenues as did lower revenues (roughly 15% in each category). However, while revenue gains averaged 8%, revenue losses averaged 20.4% thus suggesting that adverse effects outweighed positive effects on revenues when we view the experience of all restaurants. ■ 30% of Restaurant Bars Report Revenue Losses Average declines of 29% are reported. Only 12% reported revenue gains (average gain of 14%). Adverse effects therefore appear to outweigh positive effects for both restaurants and restaurant bars when we view the experience of all restaurants. ■ Restaurant Bars Are More Adversely Impacted Than Restaurants Twice-as- many restaurant bars reported revenue losses than did restaurants, thus demonstrating that the adverse effects of the smoking ban are more directly focused on restaurant bars. ■ 12% of Restaurant Bars Report Lower Wales and Salaries Average reductions are 21%. Only 6% of restaurant bars report increases, with an average gain of 19%. The evidence suggests that employees lose wages and salaries when we view the experience of all restaurant bars. ■ 9% of Restaurant Bars Report Lower Numbers of Employees Only 3.5% reported higher numbers of employees. Gains averaged about 3.3%, while losses averaged about 3.7%, thus suggesting that losses outweighed gains when we view the experience of all restaurant bars. ■ 13% of Restaurants and 25% of Restaurant Bars Report Lower Tips Only 5% of restaurants, and 6% of restaurant bars, report higher tips. For restaurants, average gains were 8.7%, while average losses were 17.8%, thus indicating an overall adverse effect on tips. For restaurant bars, average gains were 8%, but average decreases in tips were 25%, thus indicating a much greater negative effect on tip income for restaurant bar employees. Lower Revenues Most Often Experienced by Businesses Serving Many Smokers ■ Lower revenues are experienced by 30% of owners providing 0%-25% non-smoking seating, by 40% of owners providing 26%-50% non-smoking seating, and by 60% of owners providing 51%-75% non-smoking seating. ■ In sharp contrast is the experience of owners who previously provided mostly non- smoking seating (between 76%-100%): only 5% of this group experienced lower revenues. ■ These results are entirely consistent with the economic model of how smoking bans affect businesses because they confirm that owners who serve relatively many smokers are most often harmed by smoking bans. He pointed out that it is a well-known fact that drinking drivers kill innocent people. Mr. Sherman said that he doesn't understand the logic behind basing the proposed smoking ban on the premise that it is a public health concern when no mention is made of banning alcohol. Smoking usually does not involve a change in behavior whereas alcohol consumption does and leads to a lot a violent acts by people who would not act if sober. Mr. Sherman is bang slap dab right.
