HomeMy WebLinkAboutA002 - Council Action Form dated February 13, 2001 r 1 ITEM # v DATE COUNCIL ACTION FORM SUBJECT: REVISION TO MUNICIPAL CODE SECTION 17.30 - NUISANCE PARTY ORDINANCE. BACKGROUND: The Nuisance Party Ordinance has been a valuable tool in the Police Department's effort to deal with private party concerns. Once a nuisance party violation infraction has been issued, a letter is sent to the property owner advising them of the event and their potential liability if such actions reoccur. Most property owners have been extremely helpful in working with the department, and the renter, to eliminate further problems. A recent Iowa District Court decision pointed out that we had failed to include unlawful possession of alcohol as one of the activities occurring at an event that triggers a violation of the nuisance party ordinance. The change in the Code adds unlawful possession of alcohol into the definition of nuisance party violations. ALTERNATIVES: 1. Pass the revision to the Municipal Code Section 17.30. 2. Do not pass alternative. MANAGER'S RECOMMENDED ACTION: It is the Manager's recommendation that City Council adopt Alternative #1 and pass the revision to Municipal Code Section 17.30 — Nuisance Party Ordinance. The inclusion of the crime of unlawful possession of alcohol into the definition will ensure the continued use of the tool used by police to deal with private party concerns. COUNCIL ACTION:
