ACTION FORM SUMMARY: As part of the rezoning decision on the Uthe Farm Subdivision, the City Council is supposed to take action to approve the Master Plan for the development of the property, along with the decision on the rezoning. Staff is recommending that the Master Plan for the Uthe Farm Subdivision be approved. BACKGROUND: The City Council approved the rezoning request at their meeting of November 14, 2000 and the Preliminary Plat of the Uthe Farm Subdivision on December 19, 2000. The property has been zoned Suburban Residential Low Density (SRLD) and Suburban Residential Medium Density (SRMD), as provided for in Section 29.1202 of the Municipal Code. As part of the establishment of the SRLD and SRMD zoning designations on the property, the applicant is required to obtain approval of a Master Plan as part of the rezoning process. The applicant, Uthe Farms, L.L.C., submitted a Master Plan as provided for in Section 29.1200(2) of the Municipal Code, but the action to rezone the property did not include action to approve the Master Plan. City Council is now being requested to take action to approve the Master Plan that was submitted by the applicant as part of the rezoning petition in the fall of 2000. ANALYSIS: Section 29.1200(2) and Section 29.1502(4)(c) of the Municipal Code requires that the City Council take action on a Request for Approval for a Master Plan for property to be developed according to the Suburban Residential requirements. The Master Plan requires that the applicant indicate the following characteristics with respect to property to be developed according to the Suburban Residential requirements: • Arrangement and size of lots; • Proposed zoning houndaries; • Dwelling types proposed for each lot; and • Number of dwelling units per net acre for areas to be zoned SRLD and SRMD. The applicant, Uthe Farms, L.L.C., submitted this information and the City Council is now being asked to approve the Master Plan for the Uthe Farms Subdivision. A copy of the Master plan is attached for review by City Council. ALTERNATIVES: 1. The City Council can approve the Master Plan for the Uthe Farm Subdivision. 2. The City Council can deny approval of the Master Plan for the Uthe Farm Subdivision. If, for whatever reason, the City Council would deny the Master Plan for the Uthe Farm Subdivision, corresponding action on the previous decision to rezone the property would have to be commenced to keep the zoning consistent with the Master Plan. 3. The City Council can refer this request back to staff and/or the applicant for additional information. RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve Alternative #1. This will approve the Master Plan for the Uthe Farm Subdivision, as required in Section 29.1200(2) of the Municipal Code. This action should have occurred when the action to rezone the property occurred, but staff neglected to emphasize the importance of taking action on the Master Plan at the time of the rezoning.
