COUNCIL ACTION FORM
SUBJECT: RECOMMENDATION TO CITY COUNCIL TO APPROVE AN ADDITIONAL
SERIES OF AMENDMENTS TO THE RECENTLY ADOPTED ZONING ORDINANCE
ACTION FORM SUMMARY: Staff has found that there are additional items that need to
be amended in the recently adopted Zoning Ordinance. These amendments are the result
of the continuing administration of the Zoning Ordinance and the discovery that additional
clarification and corrections are necessary.
Approval of the Zoning Ordinance Text amendments is recommended.
BACKGROUND:
As administration of the newly adopted Zoning Ordinance continues, staff has found there
is a need to make some additional changes, corrections, and clarifications to these
regulations to more accurately reflect the intent of the Ordinance and to make the
administration the Ordinance clearer for staff and the public.
The following information under the Analysis section of this Action Form is a summary by
Article and Section of the Zoning Ordinance that gives a general description of the
proposed amendments. The actual Zoning Ordinance text changes are attached to this
Action Form.
ANALYSIS:
Article 4— Development Standards. One of the changes is a clarification regarding the
location of parking within the front yard and within front yard setbacks on corner lots and
through streets. An additional change has also been made to the requirements for parking
decks to limit a specific setback for a parking ramp to the DCSC zone, which is the zone
where commercial use needs to be emphasized along the street face, and this additional
setback is not necessary in other zones. Also, clarifications were made to the
requirements for accessory buildings and detached garages.
Article 5 — Use Categories. Crematories have been added as a use. This use was not
previously addressed.
Article 7 — Residential. The use Funerary was changed to Funeral, which is a more
customary term.

Article 8 - Commercial Zones. At the direction of City Council, the maximum setback
requirement has been deleted from the CCN, Community Commercial Node, and the HOC,
Highway-Oriented Commercial, zoning districts.
Article 9 — Industrial. The uses allowed in the PI, Planned Industrial zone, were redefined
to more closely represent the types of uses that were intended in this zone.
Article 10 — Special Purpose Districts. In the S-HM zone the sideyard setbacks beyond
three stories were inadvertently left out and have been added.
Article 12 — Floating Zones. Some uses were added to the F-VR zone that were
inadvertently left out, and five commercial uses were deleted since they were either
inappropriate or were included as part of other listed uses. In the two Suburban
Residential Floating zones, the single family attached grouping of units were limited to 12
units or less.
STAFF COMMENTS:
As stated in the background section of this Action Form, these changes reflect the staff's
effort to make needed adjustments to the Ordinance based on recent experience
administering these regulations. There will be a few additional changes to the existing
Ordinance regarding commercial setbacks that are still to come.
RECOMMENDATION OF THE PLANNING & ZONING COMMISSION:
The Planning and Zoning Commission reviewed these proposed changes to the Zoning
Ordinance at their meeting of October 4, 2000 and approval was recommended.
ALTERNATIVES:
1. The City Council can approve the numerous changes that are being proposed by
staff and the Planning and Zoning Commission as part of a further adjustment to the
recently adopted Zoning Ordinance.
2. The City Council can deny the proposed changes to the Zoning Ordinance.
3. The City Council can approve some of the proposed changes to the Zoning
Ordinance.
4. The City Council can refer some or all of these proposed changes back to staff for
additional information.

RECOMMENDED ACTION:
It is recommended that Alternative #1 be adopted. This action will approve the proposed
changes to the newly adopted Zoning Ordinance, as outlined in this Action Form. These
changes, corrections, and clarifications are needed adjustments to the newly adopted
Zoning Ordinance after several months of experience at administering these regulations.
