COUNCIL ACTION FORM
SUBJECT: RE-ESTABLISHMENT OF TRANSITION URBAN REVITALIZATION
AREA C FOR PROPERTIES LOCATED AT 116 CLARK AVENUE, 415 LINCOLN WAY,
AND 419 LINCOLN WAY.
ACTION FORM SUMMARY: The property owners of 116 Clark Avenue have asked the
City Council to extend the Transition Urban Revitalization Area C for one year because of
delays getting the development underway. This can be accomplished by adopting a
resolution approving the Urban Revitalization Plan and passing the ordinance
reestablishing the Transition Urban Revitalization Area C.
Staff is recommending approval of this request.
BACKGROUND:
On July 6, 2000 a letter was received from Heartland Investments requesting that the
Transition Urban Revitalization Area C be extended for one year, to August 31, 2001. (A
date of August 31, 2000 was previously established as the end date for all of the Transition
Urban Revitalization Areas based on input from the property owners affected.)
From the beginning of the transition phase of the Urban Revitalization Area program the
proposed project for property at 116 Clark Avenue was anticipated to take the longest time
period before completion. The property owners have had difficulties that they did not
expect with development and are asking for a one-year extension of Transition Urban
Revitalization Area C. The one-year extension would enable the property owners to
complete their project and take advantage of the property tax abatement possibilities.
Also, the project has changed from a three-story office building to a one-story office
building.
An Iowa Department of Revenue rule requires that at least two buildings are included in
an Urban Revitalization Area and since Transition Urban Revitalization Area C was
established, the buildings at 116 Clark Avenue have been removed. This necessitates the
re-establishment of an updated Urban Revitalization Plan for 116 Clark Avenue. The
building at 419 Lincoln Way (which has already taken advantage of the Transition
Program) and the building at 415 Lincoln Way have been included to meet this code
requirement. These two properties will not be eligible for additional tax abatement.
The action to be taken by the City Council at this time is to approve the new Urban
Revitalization Plan for the property located at 116 Clark Avenue. Staff has indicated in the
new Urban Revitalization Plan for Area C that the end date for eligibility for the Urban
Revitalization Program is August 31, 2001.
Staff is recommending approval of the re-establishment of Transition Urban Revitalization
Area C.
ALTERNATIVES:
1. The City Council can approve an updated Urban Revitalization Plan for properties
located at 116 Clark Avenue, 415 Lincoln Way, and 419 Lincoln Way and pass an
ordinance establishing an Urban Revitalization Area for 116 Clark Avenue.
2. The City Council can deny approval of an updated Urban Revitalization Plan for
properties located at 116 Clark Avenue, 415 Lincoln Way, and 419 Lincoln Way and
pass an ordinance establishing an Urban Revitalization Area for 116 Clark Avenue.
3. The City Council can approve the action with modifications.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative #1.
This action will approve an updated Urban Revitalization Plan for properties located at 116
Clark Avenue, 415 Lincoln Way, and 419 Lincoln Way and pass an ordinance establishing
an Urban Revitalization Area for 116 Clark Avenue. This will allow the construction of a
one-story office building at 116 Clark Avenue, with a Plan end date of August 31, 2001.
