Upon application being made for either or both of the said -permits or ;ense.s , the council may, at its discretion and judgment grant or refuse the same , ;ording to the location of the place , in reference to dwellings , churches , lools , fife stations , or congested traffic conditions . ;tion 5. Any person , firm or corporp'tion operating, maintaining g Or conducting ;her the said gasoline pump or filling station , or keepinf or storing inflamm-- _e oils in quantities of more than sixty gallons , witLout having first obtained- said permit or license ; or any 71e7_'son aiding or abetting therein, or f,; vio- ing any provision of this ordinance , shall upon conviction be fined a sum not seeding one hundred dollars and costs , and shall be committed to' the city or anty jail until such fine and costs are paid , not exceeding thirty days. All ordinances or parts thereof in conflict herewith are hereby repealed. ction 9 . The, provisions of this ordinance shall not effect such gasoline pump filling stations as are now in actual operation under permit from this council. ction 10.
