HomeMy WebLinkAboutA002 - Council Action Form dated August 22, 2000 ITEM # 37 DATE 08/22/00 COUNCIL ACTION FORM SUBJECT: MOTION TO RECOMMEND APPROVAL OF A TEXT AMENDMENT TO THE ZONING ORDINANCE, REGARDING PARKING IN THE "DCSC" ZONING DISTRICT. ACTION FORM SUMMARY: A text amendment to the Zoning Ordinance is being proposed to correct the parking requirements for the "DCSC" zoning district, which were inadvertently left out of the approved Zoning Ordinance text. Approval of the Zoning Ordinance text amendment is recommended. BACKGROUND: When the new Zoning Ordinance went into effect on May 1, 2000, exceptions to the off-street parking requirements were inadvertently lost for several uses in the "DCSC" Downtown Campustown Service Center zoning district. This happened when three columns in Table 29.406(2) were collapsed into two columns and the words "All zones except DCSC" were not added to the appropriate uses. As a result, as the Ordinance is currently written, off-street parking is required in the Downtown and Campustown commercial areas for all office uses; all retail and service uses; entertainment, restaurant and recreation uses; banks; and places of worship. It was not the intent of the City to require off-street parking for these types of uses. Therefore, staff has prepared a revised Table 29.406(2), which has restored the three column approach, so that it is clear what uses in the "DCSC" zoning district require off-street parking and what uses do not have an off-street parking requirement. Refer to the two attachments. The first attachment is the existing Table 29.406(2) and the second attachment is the revised Table 29.406(2). ANALYSIS: This revision to the Zoning Ordinance is necessary to restore the original intent for off-street parking in the Downtown and Campustown areas. It was not intended that off-street parking be required for most of the allowable uses in the Downtown and Campustown commercial areas. Adequate parking is provided in public parking lots and on the street, and commercial development is intended to take place in a pedestrian friendly, compact, dense manner with store fronts located adjacent to streets without parking lots creating breaks between uses. RECOMMENDATION OF THE PLANNING & ZONING COMMISSON: The Planning & Zoning Commission reviewed this request at their meeting of August 2, 2000 and have recommended that these amendments to the Zoning Ordinance be approved. ALTERNATIVES: 1. The City Council can approve the text amendment to the Zoning Ordinance to provide for exceptions to the off-street parking requirements for specific uses in the "DCSC" zoning district. 2. The City Council can deny the approval of the proposed amendment to the Zoning Ordinance to allow for exceptions to the off-street parking requirements for specific uses in the "DCSC" zoning district. 3. The City Council can approve the proposed text amendment with modifications. 4. The City Council can refer the proposed Zoning Ordinance text amendment exceptions to the off-street parking requirement in the "DCSC" zoning district back to City staff for additional information. RECOMMENDED ACTION: It is recommended that Alternative #1 be adopted. This is a recommendation to amend the Zoning Ordinance text to -continue to except off-street parking for specific uses in the "DCSC" zone. Attachment ORDINANCE NO. AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES,IOWA,BY REPEALING SUBSECTION 29.406(2)AND READOPTING THAT SECTION REVISED FOR THE PURPOSE OF AMENDING THE ZONING REGULATIONS PERTAINING TO OFF- STREET PARKING REQUIREMENTS;REPEALING ANY AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT TO THE EXTENT OF SUCH CONFLICT; PROVIDING A PENALTY;AND ESTABLISHING AN EFFECTIVE DATE. BE IT ENACTED,by the City Council for the City of Ames,Iowa,that: Section One. The Municipal Code of the City of Ames,Iowa shall be and the same is hereby amended by repealing Subsection 29.406(2)and readopting that subsection revised to state as follows: "Sec.29.406. OFF-STREET PARKING. (2) Required Parking Spaces. Off-street parking spaces must be provided in accordance with the minimum requirements set forth in Table 29.406(2)below,for any new building constructed and for any new use established. (a) The off-street parking space requirement for a use not specifically mentioned herein is the same as required for a use of similar nature. (b) Whenever a building erected or established after the effective date of this Section is enlarged in floor area,number of employees,number of dwelling units,seating capacity or otherwise to create a need for an increase of 10%or more in the number of existing parking spaces,such spaces shall be provided on the basis of such enlargement or change. (c) Whenever a building existing prior to the effective date of this Section is enlarged to the extent of 50%or more in the floor area,said building or use shall then and thereafter comply with the parking requirements set forth herein. Violation of the provisions of this ordinance shall constitute a municipal infraction punishable by a penalty of$500 for a person's first violation and a penalty of$750 for each repeat violation. 3 Section Three. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict,if any. Section Four.
