HomeMy WebLinkAboutA009 - Council Action form dated August 8, 2000 ITEM #: 41;0 DATE: 08/08/00 COUNCIL ACTION FORM SUBJECT: MOTION TO APPROVE THE REZONING OF THE FERGUSON SUBDIVISION AND PAULSEN PROPERTY FROM "AGRICULTURAL" TO "RESIDENTIAL LOW DENSITY". ACTION FORM SUMMARY: On July 11, 2000, City Council took action to annex land in the Southwest Growth Area known as the "Ferguson Annexation Area". Through annexation procedure, the area was zoned Agricultural. Staff is recommending that the Ferguson Subdivision and the Paulsen property be rezoned to Residential Low Density. Approval of this rezoning is recommended by staff. BACKGROUND: On July 11, 2000, an area known as the Ferguson Annexation Area (located in the Southwest Growth Corridor) was annexed into the City of Ames. Through the annexation process, no zoning was requested for the area. Therefore, under rezoning procedure as it relates to annexation, this area was zoned Agricultural. An agricultural zone designation has made the Ferguson Subdivision, a single-family residential subdivision, and a parcel of property on the northwest corner of State Avenue and Dartmoor Lane, non-conforming. In addition, an agricultural zone designation for these residential properties is inconsistent with the Land Use Policy Plan. Therefore, staff is recommending that the Ferguson Subdivision and the Paulsen property (northwest corner of State Avenue and Dartmoor Road) be rezoned to Residential Low Density, a zoning designation for these properties that will be in accordance with the Land Use Policy Plan. ANALYSIS: Zoning. The subject properties are currently zoned Agricultural. (When land is annexed into the City of Ames and no zone designation is requested, it will automatically be given an agricultural zoning designation.) The residential uses in the Ferguson Subdivision and the parcel of land owned by Paulsen are deemed non-conforming uses. Therefore, staff is recommending a zoning change as follows: • 6.28 gross acres of land known as the Ferguson Subdivision from A (Agricultural, City of Ames) to RL (Residential Low Density, City of Ames); r • 3.86 gross acres of land located on the northwest corner of Dartmoor Road and State Avenue from A (Agricultural, City of Ames) to RL (Residential Low Density, City of Ames). Even with this recommended zone designation, this property will remain non-conforming due to the current use, which is a three (3) unit residential structure. (See map titled "Rezoning Map'I Utilities. Water. At the present, municipal water infrastructure has not been extended to these properties. To serve the Ferguson Subdivision and the Paulsen property, the City will extend a 12-inch water main from the end of the existing water main on State Avenue. This water main extension will accommodate future development west of the Ferguson Subdivision for future annexations in the Southwest Growth Priority Area. Sanitary Sewer. Municipal sanitary sewer infrastructure will be extended to these properties. Presently, the Ferguson Subdivision utilizes failing septic systems in an attempt to treat their waste water. To correct this problem and provide adequate serdicEDs, the City will extend an 18-inch sanitary sewer main into the southern ravine (south of the Ferguson Subdivision). This will follow a route to accommodate the subdivision and the Paulsen property, and future growth west of the Ferguson Subdivision in the Southwest Growth Priority Area. An 8-inch sanitary sewer main would be extended from the 18-inch main to serve the Ferguson Subdivision. Street Access/Traffic Impact. Access to the subject properties is from Dartmoor Road, Dartmoor Drive, and Dartmoor Lane. Presently all three roads are gravel and would be paved at some future date, to be determined by the City, or at the time the adjacent property owners petition the City to construct the street improvements. Fire and Police Department Response Time and Services. The City of Ames' estimated emergency responsE! time is 4.56 minutes to the intersection of Dartmoor Road and State Avenue. These properties fall within the City of Ames' response time goal. Currently, the City of Ames Police Department patrols State Avenue to Zumwalt Station Road. Dartmoor Road is presently an access route to South Dakota for patrol vehicles and police patrols. These properties have a marginal impact on Police Department resources. 2 STAFF COMMENTS: Rezoning the Ferguson Subdivision and the Paulsen property is consistent with the LUPP. In addition, it will allow for further residential intensification or densities in Ferguson Subdivision and the potential for future single family residential development on the Paulsen property. Rezoning these subject areas is strongly recommended by staff. RECOMMENDATION OF THE 13LANNING & ZONING COMMISSION: The Planning and Zoning Commission reviewed this request at their meeting of July 19, 2000 and approval of this rezoning proposal was recommended. ALTERNATIVES.- 1. The City Council can approve the rezoning of the Ferguson Subdivision and Paulsen property from Agricultural to Residential Low Density. 2. The City Council can cleny the rezoning of the Ferguson Subdivision and Paulsen property from Agricultural to Residential Low Density. 3. Action on this request can be postponed and referred back to City staff and/or the applicant for additional information. RECOMMENDATION It is recommended that Alternative #1 be adopted. Alternative #1 is an approval of the request of the rezoning of the Ferguson Subdivision and Paulsen property from Agricultural to Residential Low Density.
