COUNCIL ACTION FORM
SUBJECT: RESOLUTION DENYING REQUEST FOR DESIGNATION AS AN URBAN
REVITALIZATION AREA FOR 316 LINCOLN WAY.
ACTION FORM SUMMARY: On March 28, 2000 the City Council referred back to City staff
the request by the property owner of 316 Lincoln Way to negotiate a monument sign to
meet the standards of the Urban Revitalization Program. City staff believes the proposed
sign by the property owner does not meet the current sign standards of the Urban
Revitalization Program.
Staff recommends denial.
BACKGROUND:
The City Council directed staff to work with the property owner of 316 Lincoln Way to find
an acceptable sign to meet the monument sign standard in the Urban Revitalization
Program criteria. The applicant had not met the parking requirement or the signage
requirement. The City Council had indicated a willingness to waive the shared parking
standard but not the signage standard. The applicant is anxious to keep the process
continuing, as they would like to begin construction in the month of June 2000.
The applicant has proposed a 15-foot tall sign. The sign is proposed to have an
approximate six (6) foot base of masonry material with a one (1) foot strip sign followed by
a two (2) line reader board topped with a Dairy Queen emblem (see attached picture). The
applicant has indicated that Dairy Queen has no standards for monument signs.
City staff has not developed specific standards for monument signs. Conceptually staff
believes that monument signs would be low to the ground, with wider bases and possibly
structural features that begin at ground level and continue to include the entire sign. There
are myriad designs and styles that could be considered for the construction of monument
signs. City staff would like to further develop concepts for the monument sign provisions
in the Commercial Criteria Matrix for the City Council to consider in the future. Since the
applicant has asked that this Urban Revitalization Area Application be reconsidered at this
City Council meeting to keep the project on their construction timetable, City staff does not
believe the proposed sign meets the current sign standard in the Commercial Criteria
Matrix. Since the signage option needs to be met for approval of the Urban Revitalization
Program, the applicant doesn't meet the optional requirement.
Staff is recommending denial of this request. The denial of this request for Designation
as an Urban Revitalization Area will not prohibit the applicant from erecting either
the 15' sign currently proposed or the taller pole sign approved through the site plan
process. The denial would only disallow the use of the Urban Revitalization Program
for tax incentive purposes.
ALTERNATIVES:
1. The City Council can deny the request for designation as an Urban Revitalization
Area for 316 Lincoln Way.
2. The City Council can approve the request for designation as an Urban Revitalization
Area for 316 Lincoln Way, and waive the optional requirement of shared parking and
directing City staff to prepare an Urban Revitalization Plan for 316 Lincoln Way and
setting a date for public hearing of May 23, 2000.
3. The City Council can refer the sign issue back to staff for further review.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative #1 .
This action will deny the request by the property owner to be designated an Urban
Revitalization Area for 316 Lincoln Way, on the basis that the applicant does not meet the
current signage option under the Urban Revitalization Commercial Criteria Matrix.
