City Staff has advised Mr. Sorenson that he is to have a minor plat completed before the site plan for a new Dairy Queen at 316 Lincoln Way, Ames, Iowa, can be approved. The cost of completing a minor plat is approximately $6,000 and it delays the process approximately two months. We do not see that a minor plat will accomplish anything in this matter, but will only increase Mr. Sorenson's expenses and delay the process. Section 23.103 of the Municipal Code of the City of Ames, Iowa, provides for the City Council modifying or waiving the requirements of the Regulation requiring a minor plat if it "would result in extraordinary hardship to the Applicant or would prove inconsistent with the purpose of the Regulations because of unusual topography or other conditions". Section 23.102(1) of the Municipal Code of the City of Ames, Iowa, identifies the purposes of the Regulations as: (a) Providing for accurate clear and concise legal description of the real estate; (b) Providing a balance between use rights of the individual and economic, social and environmental concerns of the public; (c) To encourage orderly development. It is respectfully submitted that waiving the requirement of having a minor plat will still fulfill and satisfy each of the purposes of this Regulation. The right of the individual to avoid approximately $6,000 in unnecessary expense and two months delay will be accomplished by waiving the requirement of a minor plat and the economic, social and environmental concerns of the public will not be affected by a waiver of this minor plat. Orderly development will still occur with a waiver of this minor plat. Therefore, Ed Sorenson respectfully requests the City Council to waive the requirement of a minor plat in this matter.
