SUBJECT: Zoning Ordinances
As you know, it is planned that the City Council will, at its regularly scheduled meeting of March
28,2000, give first passage to the two ordinances that will establish new and comprehensive zoning
regulations with respect to the entire City of Ames. One ordinance is to establish the text of the new
zoning regulations. The other ordinance is to establish a new zoning map showing the location of
the zoning districts, including overlay districts. The "text" ordinance will be provided to when it
gets final clearance from the Planning staff. Eden Schmitt indicated to me yesterday that there may
be a need for a few tweaks, but nothing inconsistent with what has been approved by the P&Z
Commission and City Council. The"map"ordinance was provided with your copy of a January 18
memo to Brian O'Connell. If you need another copy, let me know.
With this are the two notices of hearing that must be published. One is for the hearing on the"text"
((,^ ordinance, the other is for the hearing on the "map" ordinance. Each of the two notices must be
JJ published in the Ames Tribune at least once not less than seven days before the March 28 Council
meeting. In my opinion, the notices are statutorily and constitutionally adequate based on the
U decision of the Iowa Supreme Court in Quality Refrigerated Services, Inc. v. City of Spencer, 586
N.W.2d 202, 206 (Iowa 1998).
