Motion by: Campbell Second by: Cross Voting aye: Campbell, Cross, Goodhue, Hoffman, Quirmbach, Wirth Voting nay: None Absent: None By: (_ yJ.,(CL yt�J(JG�4 Diane Voss, City Cleric Copy to: Brian O'Connell 013 b STAFF REPORT City Council Decision On Selected properties BACKGROUND: At the December 7, 1999 meeting of the City Council, the Council decided to take up several additional properties where there is still a question regarding the appropriate zoning designation for the property. These selected properties are the result of individual owners requesting that the City Council consider a different zoning designation from the designation recommended by the Planning and Zoning Commission and the City staff. These properties include: 412 Hayward✓ 2817 Oakland✓ 2823 Oakland ANALYSIS: Since the City Council meeting of December 7, 1999, several additional property owners are seeking a different zoning designation. These include: 619 South 4th Street -' 621 South 4th Street✓ The lots that front on the north and south side of Story Street between Howard Avenue and Wilmoth Avenue. The owner of the property at 611 Duff Avenue has expressed concern that the new lot width standard in the Neighborhood Commercial Zone will make this property useless. The nonconforming provisions in the new ordinance allows a full use of lots that exist before the effective date of the ordinance. The use must meet the use, density, and coverage standards. Therefore, the real affect of the new regulation is the difference between the existing P-C regulations and the proposed Neighborhood Commercial regulations. Therefore, this lot is in no way useless. The recommendation that has been forwarded by the Planning and Zoning Commission and the staff relative to these properties remains the same as originally recommended. s:\caflselectedzoning 111
