AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF
AMES,IOWA,BY REPEALING SECTIONS 32.101,32.102,32.104(1)(j),32.201,
AND 32.301;AND,ENACTING NEW SECTIONS 32.101,32.102, 32.104(1)(j),
32.201,AND 32.301,ALL FOR THE PURPOSE OF ADOPTING THE UNIFORM
MECHANICAL CODE, 1997 EDITION, AND THE NATIONAL FUEL GAS
CODE 3RD. WITH SOME REVISIONS AND ADDITIONS; AND IOWA
ADMINISTRATIVE CODE PART 347,CHAPTERS 41-49;REPEALING ANY
AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT TO THE
EXTENT OF SUCH CONFLICT; PROVIDING A PENALTY, AND
ESTABLISHING AN EFFECTIVE DATE.
BE IT ENACTED,by the City Council for the City of Ames,Iowa,that:
Section One. The Municipal Code of the City of Ames,Iowa shall be and the same is hereby amended by repealing
Sections 32.101, 32.102,32.104(1)(j),32.201 and 32.301.
Section Two. The Municipal Code of the City of Ames,Iowa shall be and is hereby further amended by enactment
of new sections and subsections as follows:
"Sec.32.101. MECHANICAL CODE ADOPTED.
The Uniform Mechanical Code, 1997 Edition (herein called `UMC') as published by the
International Conference of Building Officials,shall be the Mechanical Code for the City of Ames,Iowa,
except for such modifications,additions or deletions as hereinafter enacted. The Uniform Mechanical
Code standards and the Uniform Building Code standards contained in Appendix A,and Appendices B,
C,and D of the UMC are adopted as parts of the Mechanical Code for the City of Ames.
See.32.102. SCOPE.
Delete Sec. 103 UMC and insert in lieu thereof the following:
Scope. The provisions of this Code shall apply to the erection,installation,alteration,repairs,
relocation,replacement,addition to,use or maintenance of any heating,ventilating,cooling,incinerators
or other miscellaneous heat producing appliances within this jurisdiction. Additions,alterations,repairs
and replacements of equipment or systems shall comply with the provisions for new equipment and
systems except as otherwise provided in Section 104 of this Code.
Sec.32.104. REGISTRATION.
(1)(j) Exemption for Homeowner: No such registration procedure shall be required for
alteration or repair work to be performed on a single family residential structure when the person
performing the alteration or repair work is the owner of the structure, and has his/her legal residence
there. The homeowner shall be automatically termed a Registrant for the purposes of such a project.
Notwithstanding such relief from registration,all requirements for permits for the work shall remain in
force. The homeowner shall be required to show the city mechanical inspector a drawing of how the
mechanical work will be done before a permit is issued. The city mechanical inspector may waive the
drawing when it is reasonable to do so.
Sec.32.201. AMENDMENTS,ADDITIONS AND DELETIONS.
The provisions of the UMC for the City of Ames are modified as follows:
(1) Delete Sec. 801 UMC and insert in lieu thereof the following:
(a) Appliances designed to be vented shall be connected to a venting system as
specified in Section 802 and the venting system shall comply with the provisions of this chapter,except
as provided in this section.
(b) Venting systems shall consist of approved chimneys,Type B vents,Type BW
vents,Type L vents,plastic pipe recommended by the manufacturer of listed condensing appliances for
use with specified models,or a venting assembly which is an integral part of a listed appliance.
(c) Venting systems shall be designed and constructed so as to develop a positive
flow adequate to convey all combustion products to the outside atmosphere.
(d) Venting systems may be designed in accordance with accepted engineering
methods when the design method has been approved by the building official.
(e) A venting system which is an integral part of the vented appliance and plastic
pipe recommended by the manufacturer in installation instructions as suitable for use with listed
condensing appliances shall be installed in accordance with the appliance listing, manufacturer's
installation instructions and applicable requirements of this code.
(f) Gas venting systems serving appliances equipped with draft hoods and
appliances listed for use with Type B vents may be designed in accordance with Appendix C,Chapter
8,UMC,for sizing purposes only. In addition to said Appendix C,the following also applies:
(i) For single appliance vents:
If the vertical vent or We lined chimney has a larger diameter or flow
area than the vent connector,use the vertical vent diameter to determine the maximum vent capacity. The
flow area of the vertical vent,however shall not exceed 4 times the flow area of the listed appliance
categorized vent area, draft hood, outlet area or flue collar area unless designed in accordance with
approved engineering methods.
(ii) For multiple appliance vents:
The flow area of the largest section of vertical vent or chimney shall
not exceed 4 times the smallest listed appliance categorized vent area,flue collar area,or draft hood outlet
area unless designed in accordance with approved engineering methods.
(iii) Single wall metal pipe used as a connector shall not originate in an
unoccupied attic or concealed space and shall not pass through any attic,inside wall,floor,or concealed
spaces and shall be located in the same room or space as the fuel burning appliance or other device.
(2) Boilers. Sec. 1001 in Appendix B Chapter 10 UMC is amended by the addition of
an unnumbered paragraph to that section as follows:
Notwithstanding the requirements of this code,boilers and pressure vessels covered by Iowa
Code Chapter 89 shall comply with the requirements established by the Labor Services Division,as set
out in the Iowa Administrative Code,Part 347,Chapters 41-49. Those rules and regulations are adopted
as a part of this code by this reference as if set forth fully herein.
(3) Delete Chapter 13 of the 1997 Uniform Mechanical Code and adopt the National Fuel
Gas Code,3rd edition. Published by the National Fire Protection Association and International Approval
Services-US INC.
(4) The National Fuel Gas Code is amended by adding: Only fittings approved for welded
system shall be used. Screw type fittings shall not be welded. Screw type fittings may be used in
concealed spaces, except for unions and bushings. Low pressure gas shall be tested with air for 15
minutes at 10 psi. Medium pressure shall be tested 30 minutes at 60 psi.
(5) Whenever an inspector issues a correction notice in writing for work that is completed,
said work shall be corrected in 30 calendar days of such notice,except that when there is immediate
hazard,corrections shall be made immediately.
(6) No license or registration shall be required for a mobile home dealer to perform water,
gas or utility service connections in a mobile home space or within ten feet of such space,located in a
mobile home park,all within the meaning and intent of Sec. 322B.3(5)Code of Iowa. The requirements
for permits and inspections remain in effect, and the mobile home dealer shall pay the permit and
inspections fees.
Sec.32.301. PENALTY.
Any person,corporation or other legal entity who violates any of the provisions of this chapter
commits a municipal infraction punishable by a civil penalty of five hundred dollars($500)for the initial
offense, and seven hundred fifty dollars ($750)for each repeat offense. Each day that a municipal
infraction occurs constitutes a separate offense. Any person,corporation or other legal entity who violates
this ordinance after having previously been found guilty of violating the same ordinance provisions at the
same location or at a different location shall be considered to have committed a repeat offense. Seeking
a civil penalty as authorized in this section does not preclude the city from seeking alternative relief,
including an order for abatement or injunctive relief."
Section Three. Violation of the provisions of this ordinance shall constitute a municipal infraction punishable as
provided by law.
Section Four. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such
conflict,if any.
Section Five. This ordinance shall be in full force and effect from and after its passage and publication as required
by law.
