COUNCIL ACTION FORM
SUBJECT: MOTION TO APPROVE AN AMENDMENT TO THE PROPOSED
SUBDIVISION REGULATIONS PRIOR TO THE ADOPTION OF THE ORDINANCE
APPROVING THE SUBDIVISION REGULATIONS ON THIRD READING.
ACTION FORM SUMMARY: An amendment to the proposed subdivision regulations is
being proposed by staff regarding the applicability of the regulations. The proposed
regulations require that all land be platted before a permit can be issued. The amendment
would require platting only when a permit is being requested for the construction of a
principle building.
Staff recommends that this amendment be approved.
BACKGROUND:
The proposed subdivision regulations are being considered by the City Council for approval
on the third reading of the ordinance that would adopt the regulations. As part of the
review of the administrative procedures for these new regulations, staff (the Building
Official) has detected a provision in the proposed regulations that needs to be changed.
The Section that needs to be amended is Section 23.102 regarding the application of the
regulations. Staff believes there are significant advantages to the City and the property
owners if this change is made prior to the regulation being finalized by the City Council.
ANALYSIS:
Section 23.102 would require that a plat of subdivision be approved before any permit of
any kind could be issued by the City. The Building Official indicated that this provision
would be problematic for property owners who simply wanted to construct a deck or install
a room addition to an existing building.
Clearly, it has been the intent of staff to apply the subdivision regulations to the
construction or installation of new buildings and not building additions. As a result, the
proposed subdivision regulations now contain a revision to Section 23.102 that requires
a plat of subdivision only where a permit is being requested from the City for a principal
building. Therefore, such activity as building additions, decks, accessory buildings, and
other non-principal structures on a lot can be permitted without first platting the lot.

second line of Section 23.102 (2)(a)].
ALTERNATIVES:
1. The City Council can approve the amendment to the proposed subdivision
regulations.
2. The City Council can decide not to approve the amendment to the proposed
subdivision regulations.
3. The City Council can modify the amendment to the proposed subdivision regulations.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative #1.
This action will approve the amendment to the proposed subdivision regulations and
thereby enabling building additions, decks, and similar smaller changes to existing
structures be constructed without having to plat the property. Permits for principal
buildings can be issued only after the property has first been platted and the plat has been
approved by the City.
