HomeMy WebLinkAboutA002 - Council Action Form dated February 9, 1999 M Item # ILI Date: February 9, 1999 COUNCIL ACTION FORM SUBJECT: FIRST READING OF ORDINANCE TO ESTABLISH FREEL DRIVE/EAST LINCOLN WAY WATER AND SEWER CONNECTION DISTRICT BACKGROUND: When a City installs utilities abutting undeveloped properties, the City may assess the project or the City may recoup construction costs through fees collected at the time utility service is requested as allowed by Section 384.38(3) Code of Iowa, 1997. This ordinance establishes fees to be charged to the developable portion of the Lange's farm property south of East Lincoln Way and east of the Skunk River. The developable portion of the Lange's property in the flood plain that can be filled amounts to 12.745 acres and is shown on the attached plat. The proposed fee for sanitary sewer improvements is $1,185.64 per acre and the proposed fee for water main improvements is $823.53 per acre. If the entire area is developed, the City could recoup up to $15,105 for sanitary sewer improvements and up to $10,500 for water main improvements that have been installed by the City and not assessed to the Lange's property. The costs for the sanitary sewer improvements were determined from the Freel Drive sanitary sewer lift station assessment that was to be levied on the Lange's property. The costs for water main improvements were determined by using the property frontage along East Lincoln Way and multiplying it by the established water main fee of $10.00 per foot. ALTERNATIVES: 1. Approve the ordinance and recoup City costs to install utilities when properties are developed. 2. Reject the ordinance and do not recoup City costs to install utilities. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council approve the East Lincoln Way Water and Sewer Connection District ordinance. COUNCIL ACTION:
