HomeMy WebLinkAboutA002 - Council Action Form dated May 12, 1998 Item # 3o b C/ Date: May 12, 1998 COUNCIL ACTION FORM SUBJECT: APPROVAL OF REVISED DEVELOPMENT AGREEMENT AND PUBLIC HEARING FOR PASSAGE OF AN ORDINANCE TO VACATE A PORTION OF GRANT AVENUE FROM BLOOMINGTON ROAD TO THE NORTH LOT LINES OF THE PLATTED LOTS IN BLOOMINGTON HEIGHTS PLAT 7 (1,400') AND APPROVAL OF RESOLUTION TO TRANSFER RIGHT-OF-WAY TO ADJACENT PROPERTIES. BACKGROUND: William C. Knapp Revocable Trust has purchased the properties along Grant Avenue south of the north section lines of Sections 27-84-24 and 28-84-24 for development as Bloomington Heights Subdivision. The land encompassing Grant Avenue is platted in Bloomington Heights Plat 6 and 7. In addition, the 460' of the east half of Grant Avenue immediately north of the Bloomington area intersection is adjacent to property owned by the Stone Brooke Church of Ames. The right-of-way is 33' on each side of the centerline of Grant Avenue (see attached map). The revised development agreement provides for the developer to construct all of the traditional public improvements in the subdivision, as well as payment for construction of the additional lane on Bloomington Road adjacent to the subdivision. In addition, the developer will be responsible for the payment of a water connection fee based on the frontage of the development along Bloomington Road. As part of the development of Bloomington Heights Plat 7, the developer is to relocate Grant Avenue to the west and it is to be renamed Hyde Avenue (note the attachment) in order for this to take place, the City must vacate that portion of Grant Avenue from Bloomington Road to the north lot lines of the platted lots in Bloomington Heights Plat 7. There will also be a transfer of right-of-way to the adjacent properties. It should also be noted that land for Grant Avenue has been dedicated to the City at no cost. 8 The most southerly 600' of the west half of Grant Avenue is within property to possibly be sold to the City of Ames Department of Parks and Recreation for use as a City park. When street right-of-way is vacated, the usual policy is to sell the land to the adjacent owner. In this situation, that policy does not apply. The west one-half of the right-of- way is held by easement so it reverts back to the underlying landowner. In addition, the developer is relocating the street and affected utilities at their cost. The City will receive a newly paved street in replacement of the current gravel road. Thus, the transfer of this right-of-way should be at no cost to the developer. CAF —Vacate portion of Grant Avenue May 12, 1998 Page 2 The Stone Brooke Church owns the property adjacent to the right of way on the east portion of the southerly 460 feet of the street. Because their property has never been included in a formal plat, that right of way is also held by easement. Thus, if the street is vacated, the land reverts to the adjacent owner. Action on that vacation will come at a later date. ALTERNATIVES: 1. Approve the revised development agreement which contains the stipulations made when the Conceptual Development Plan for the area was revised and, following the public hearing, adopt the first reading of the ordinance vacating the appropriate portion of the Grant Avenue right-of-way. In addition, following the hearing on the transfer of the land to the Knapp Trust, final action should be tabled until the final plat of the area is filed and the right-of-way of Hyde Avenue, the connecting street, is created. 2. Reject the concept of re-aligning Grant Avenue and vacating the right-of-way. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council accept Alternative Number 1 and approve the development agreement, adopt on first reading the ordinance vacating the Grant Avenue right of way, and table action on the resolution transferring the right-of-way to the Knapp Trust until the final plat for Bloomington Heights Plat 7 is submitted for approval.
