HomeMy WebLinkAboutA001 - Council Action Form dated April 28, 1998 r ; Item # ao a 4-b Date: April 28, 1998 COUNCIL ACTION FORM SUBJECT: SET HEARING DATE FOR ORDINANCE TO VACATE A PORTION OF GRANT AVENUE FROM BLOOMINGTON ROAD TO THE NORTH LOT LINES OF THE PLATTED LOTS IN BLOOMINGTON HEIGHTS PLAT 7 (1,400') AND APPROVE A RESOLUTION TO TRANSFER RIGHT-OF-WAY TO ADJACENT PROPERTIES. BACKGROUND: William C. Knapp Revocable Trust has purchased the properties along Grant Avenue south of the north section lines of Sections 27-84-24 and 28-84-24 for development as Bloomington Heights Subdivision. The land encompassing Grant Avenue is platted in Bloomington Heights Plat 6 and 7. In addition, the 460' of the east half of Grant Avenue immediately north of the Bloomington area intersection is adjacent to property owned by the Stone Brooke Church of Ames. The right-of-way is 33' on each side of the centerline of Grant Avenue (see attached map). As part of the development of Bloomington Heights Plat 7, the developer is to relocate Grant Avenue to the west and it is to be renamed Hyde Avenue (note the attachment) in order for this to take place, the City must vacate that portion of Grant Avenue from Bloomington Road to the north lot lines of the platted lots in Bloomington Heights Plat 7. There will also be a transfer of right-of-way to the adjacent properties. It should also be noted that land for Grant Avenue has been dedicated to the City at no cost. 8 The most southerly 600' of the west half of Grant Avenue is within property to possibly be sold to the City of Ames Department of Parks and Recreation for use as a City park. Utilizing the standard policy for disposal of City property, the land value is reduced by 10% for the quit claim deed and it is further reduced by the cost to relocate the utilities in the area. The value of the land is $13,000 per acre in the surrounding area. Thus it is reduced to $11,700 due to the quality of the deed provided. It is further reduced by $13,000 due to the cost of relocating the electric facilities. Since the cost to utilize the area exceeds its value and the fact that the Developer is also replacing the street by relocating it west, there is no compensation due the City. The Stone Brooke Church does not have to incur the costs of the utility relocation and thus would have to pay $4,095 for the 0.35 acres of vacated right-of-way adjacent to them per the City's policy. If they did not wish to purchase the property, the City could retain it as parkland since it would be adjacent to the proposed park property. Establish May 12, 1998 as the date of the Public Hearing on the vacation of a portion of Grant Avenue and approve the resolution transferring the property to the adjacent owners subject to the established right-of-way transfer policy. 2. Reject the concept of re-aligning Grant Avenue and vacating the right-of-way- MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council accept alternative number 1 and establish May 12, 1998 as the date of the Public Hearing on the vacation of a portion of Grant Avenue and approve the resolution transferring the property to the adjacent owners subject to the established right-of-way transfer policy.
