HomeMy WebLinkAbout~Master - Mandating Underground Installation of Electric Utilities in all new subdivisions ORDINANCE NO. 3495 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES, IOWA,BY ADOPTING A NEW SECTION 23.28.1 FOR THE PURPOSE OF MAKING UNDERGROUND INSTALLATION OF ELECTRIC UTILITY FACILITIES, AT DEVELOPERS EXPENSE, MANDATORY IN ALL NEW DEVELOPMENTS. BE IT ENACTED, by the City Council for the City of Ames, Iowa, that: Section Oue. The Municipal Code of the City of Ames, Iowa shall be and is hereby amended by adding a new section as follows: "Sec. 23.28.1. ELECTRIC DISTRIBUTION AND STRFET LIGHTING Y TEM IN NEW SUBDIVISIONS AND DEVELOPMENT AREAD. (1) There shall be constructed an underground electric distribution system to adequately serve all lots within the platted area, with due regard to the present and reasonably foreseeable needs of the entire area shown in the conceptual development plan. When the area being developed is in the service territory of the Ames Municipal Electric Utility, the Utility shall install the electric distribution system underground,but the Developer shall pay to the City the costs of an underground electric distribution system that are in excess of what would have been the cost of an overhead electric distribution system. (2) The existing overhead electric feeder system adjacent to a new subdivision shall remain overhead but may be placed underground if requested by the developer of a new subdivision. All costs associated with such conversion will be at the Developer's sole expense. (3) The electric street lighting system in new subdivisions shall be installed underground at the Developer's sole expense." Section Two. This ordinance shall be in full force and effect from and after its passage and publication as required by law.
