SUBJECT: Legislating for Local Suspension of Sales of Alcoholic Beverages
At the November 20th meeting of the Mayor's Task Force on Veishea, I was assigned the task of drafting
legislation that would authorize local authorities to suspend the license to sell alcoholic beverages on a
selective basis.
Attached is a draft of a bill to add a new subsection to Section 123.39, Code of Iowa, to vest in the Mayor
power to make short-term selective suspensions of liquor licenses and wine and beer permits of
establishments deemed to be the source of the beverages contributing to the problem.

AN ACT TO EMPOWER LOCAL AUTHORITIES TO MAKE SELECTIVE SHORT TERM
SUSPENSIONS OF LICENSES AND PERMITS FOR SALE OF ALCOHOLIC
BEVERAGES FOR THE PURPOSE OF AIDING IN THE PRESERVATION OR
RESTORATION OF PUBLIC PEACE, ORDER, AND SAFETY IN CONNECTION
WITH A SCHEDULED EVENT
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STA TE OF 10WA:
Section 1. Section 123.39, Code of Iowa, 1997, is amended by adding the following new
subsection:
NEW SUBSECTION: 5. It is found and determined that availability of alcoholic beverages
is a contributory cause of public disorder and riotous conduct by groups of people at scheduled
events. For the purpose of preserving or restoring public peace, order and safety in connection with
a scheduled event, a local authority, the Mayor of any city, or the Sheriff of any county with respect
to the unincorporated areas of that county, may suspend for a period not to exceed seventy-two hours
a liquor control license or wine or beer permit with respect to licensed premises reasonably deemed
to be a probable source of alcoholic beverages that will be a contributory cause of public disorder or
riotous conduct in connection with a certain scheduled event.
