SUBJECT: MOTION TO APPROVE THE REZONING OF 1.42 ACRES FROM R-4 (HIGH-
DENSITY RESIDENTIAL) TO R-2 (LOW-DENSITY RESIDENTIAL) IN THE HALF-BLOCK
NORTH OF LINCOLN WAY BETWEEN NORTH OAK AVENUE AND NORTH MAPLE
AVENUE, AND REZONING OF 2.84 ACRES FROM R-3 (MEDIUM-DENSITY
RESIDENTIAL) TO R-2 (LOW-DENSITY RESIDENTIAL) IN THE TWO HALF-BLOCKS
NORTH OF LINCOLN WAY BETWEEN NORTH MAPLE AVENUE AND NORTH
RUSSELL AVENUE.
ACTION FORM SUMMARY: This is a rezoning proposal initiated by the City Council.
The Planning & Zoning Commission and City staff recommend approval of the rezoning
proposal.
BACKGROUND:
Rezoning Proposal. On September 23, 1997, the City Council initiated rezoning of the
property, described above, in response to a request by property owners and residents of
the Oak/Riverside neighborhood. The neighbors requested that the City take the
appropriate action to zone the subject property to make the three half-blocks compatible
with the current zoning for the remainder of the Oak/Riverside neighborhood.

attached.
ANALYSIS:
Existing LUPP Map. The 1997 Land Use Policy Plan (LUPP) Map designates the subject
property as "One- and Two-Family Medium-Density Residential.
Existing Zoning. The subject property is divided between two zoning districts, described
as follows:
• R-4 (High-Density Residential): One-half block north of Lincoln Way between North
Oak Avenue & North Maple Avenue.
• R-3 (Medium-Density Residential): One-half block north of Lincoln Way between North
Maple Avenue & North Russell Avenue.
Proposed Zoning. City Council referred to staff the request contained in the September
17,1997 letter from the Oak-Riverside Neighborhood Association. The Council did not
specify a zoning designation for the area.
The letter from the Oak-Riverside Neighborhood Association requested that, "the City
Council take appropriate action to change immediately the zoning of the three half-blocks
making them compatible with the current zoning for the remainder of the neighborhood
from Oak to Riverside Drive". The neighborhood did not request a specific zoning
designation for the subject properties.
The remainder of the neighborhood is zoned as R1-6 (Low-Density Residential).
City staff believes the appropriate zoning designation for the subject property is R-2 (Low-
Density Residential) and not the R1-6 (Low-Density Residential) zoning district, which is
the zoning in the remainder of the neighborhood. Staffs reasons for supporting R-2 as the
appropriate zoning designation are described as follows:
• The LUPP Map designation approved for the subject property (One- and Two-Family
Medium-Density Residential) designates the land to be used for one- and two-family
dwellings.
• The LUPP Map designates this entire neighborhood for one- and two-family land
use.
• Single-family and two-family dwellings are permitted uses in the R-2 zoning district.
• The R1-6 zoning district allows single-family dwellings as permitted uses, but allows
two-family dwellings only if constructed or under construction prior to November 1,
1983, and if originally designed and built pursuant to a zoning and building permit as
a two-family dwelling, and not a single-family dwelling converted to a two-family
dwelling.
• Rezoning the subject property to R1-6 would make all of the existing duplexes non-
conforming since the duplexes were originally constructed as single-family dwellings
and were converted to two-family dwellings, at a later date.
• The City is in the process of rewriting the zoning ordinance and has not established
new zoning district regulations for implementation of the 1997 LUPP. The R-2 zoning
district is the zoning district that most closely matches the LUPP Map designation
(One- and Two-Family Medium-Density Residential), and therefore is the appropriate
zoning designation to use for rezoning, at this time.

1997 LUPP & LUPP Map. The 1997 Land Use Policy Plan (LUPP) Map designates the
subject property as: "One- and Two-Family Medium-Density Residential". This LUPP Map
designation was adopted by the City Council for a portion of the "Urban Core" that includes
single-family and two-family residential uses that involve a gross density of four (4) dwelling
units, but less than six (6) dwelling units per gross acre.
The gross density of the three half-blocks is described as follows:
• Oak Avenue to Maple Avenue: 5.79 dwelling units/acre
• Maple Avenue to Hazel Avenue: 5.00 dwelling units/acre
• Hazel Avenue to Russell Avenue: 5.13 dwelling units/acre
Utilities. Existing utilities are adequate to serve permitted land uses in the R-2 (Low-
Density Residential) zoning district.
Fire Department Response Time. The estimated Fire Department response time to the
closest node, one and one-half blocks south of Lincoln Way on Hazel Avenue, is 3.01
minutes. Five (5) minutes is the standard that the Fire Service uses for fire and first aid
response.
Access/Traffic Impact. Access to properties in the area proposed for rezoning will remain
as it currently exists, with some properties having access off the alley to the north and
others with access off Lincoln Way. The City would encourage any new development to
have access off the alley and to close any access that presently exists on Lincoln Way. No
new driveway accesses would be allowed by the City off Lincoln Way.
STAFF COMMENTS:
Staff believes the R-2 (Low-Density Residential) zoning district is the appropriate zoning
district for the subject property, for the reasons described in this report, and recommends
approval of the rezoning to R-2 (Low-Density Residential).
PLANNING & ZONING COMMISSION RECOMMENDATION:
As part of the Planning & Zoning Commission review of this rezoning issue, there was
discussion regarding the effect of a change in zoning from R-4 and R-3 to the proposed
R-2 zoning district. This discussion focused on the reduction in occupancy that would
result with the area that would be zoned R-2.
Currently, the R-3 zoning district allows for four unrelated adults and the R-4 zoning district
allows for five unrelated adults to occupy a dwelling unit. The proposed R-2 zoning
designation would limit occupancy to three unrelated adults.

After discussion, it is the recommendation of the Planning and Zoning Commission that the
area be rezoned to R-2. The Commission further recommended that the current occupancy
limits that are provided for in the R-3 and R-4 zoning districts be grandfathered as a result
of the rezoning to R-2.
In consultation with the City Attorney, it has been determined that an existing apartment
that has established an occupancy limit allowed under the R-3 and R-4 zoning
classification can maintain the same occupancy limit even if the property is rezoned to R-2.
This has been the established practice of the City.
ALTERNATIVES:
1. The City Council can approve the proposal to rezone 1.42 acres from R-4 (High-
Density Residential) to R-2 (Low-Density Residential) in the half- block north of
Lincoln Way between North Oak Avenue and North Maple Avenue, and rezoning of
2.84 acres from R-3 (Medium-Density Residential) to R-2 (Low-Density Residential)
in the two half-blocks north of Lincoln Way between North Maple Avenue and North
Russell Avenue.
2. The City Council can deny approval of the proposal to rezone 1.42 acres from R-4
(High-Density Residential) to R-2 (Low-Density Residential) in the half-block north of
Lincoln Way between N. Oak Avenue and North Maple Avenue, and rezoning of 2.84
acres from R-3 (Medium-Density Residential) to R-2 (Low-Density Residential) in the
two half-blocks north of Lincoln Way between North Maple Avenue and North Russell
Avenue.
3. The City Council can approve this proposal for rezoning, with modifications.
4. Action on this request can be postponed and referred back to City staff and/or the
applicant for additional information.
RECOMMENDED ACTION:
It is recommended that Alternative #1 be adopted. Alternative #1 is approval of the
proposal to rezone 1.42 acres from R-4 (High-Density Residential) to R-2 (Low-Density
Residential) in the half-block north of Lincoln Way between North Oak Avenue and North
Maple Avenue, and rezoning of 2.84 acres from R-3 (Medium-Density Residential) to R-2
(Low-Density Residential) in the two half-blocks north of Lincoln Way between North Maple
Avenue and North Russell Avenue.
The City council should understand that even if this area is zoned R-2, existing apartment
buildings that have established an occupancy limit that is allowed under an R-3 and R-4
zoning district, can remain.

I received a telephone call this afternoon from Linda Ersland, who lives at 122 North Maple, asking that
we please not allow the variance for the 8-plex on Lincoln Way. She said she lives along the alley and
her yard gets driven on because there is no access on Lincoln Way for a driveway. She said her yard has
also been used as a parking lot. Ms. Ersland said this is a quiet neighborhood and would like it to
remain this way. She indicated that she would not be opposed to a duplex in this area.
I asked her if she was aware that this was not the Zoning Board of Adjustment that was meeting tonight,
and that this was not a request for a variance, but a rezoning issue that was before the Planning and
Zoning Commission. She replied "yes". I told her I would type up her comment and make it available
to you.

I received a telephone call late Friday afternoon from Magdalin Walsh, who lives at 1003 Lincoln Way,
who wanted to express her objection to the above-described agenda item.
Ms. Walsh said she has an apartment building on both sides of her and the IDOT is across the street.
She is 89 years old, and if she wants to sell her home, she feels it would decrease the value of her
property. If the City wanted to rezone the property, they should have done it years ago, before all the
apartment buildings were constructed.

Dear Ms. Schmitt:
We are writing in reference to your letter of October 7, 1997, addressed "To
Whom it May Concern", regarding the request of the City Council to initiate the
rezoning of the 1.42 acres from R-4 to R-2 in the half-block of Lincoln Way
between North Oak Avenue and North Maple Avenue and rezoning of 2.84 acres
from R-3 to R-2 in the two half-blocks north of Lincoln Way between North Maple
Avenue and North Russell Avenue. We are the owners of two properties within
this area and are unable to attend the meeting of Wednesday, October 15, 1997.
We are therefore submitting this letter to register our disapproval of the request
for the change of zoning. As existing property owners we purchased the
properties with the present R-3 zoning designation and know that the change in
zoning to R-2 will have a negative impact on the value of land upon which our
properties are located.
We would appreciate being kept informed as to the developments relative to the
rezoning of the property in question.

I received a telephone call late Monday afternoon from Teresa Garman, who is the owner of property in
the above-described area, indicating that she is out of town but wanted to call to say that she is opposed
to the down zoning. She is concerned with urban sprawl and the City not wanting density within the
city. She feels there should be a longer notification time, also.

Dear Stiener Silence,
We support the down zoning to R-2 of the three half blocks along Lincoln Way between Oak and
Russell. Building multi-unit apartments in this area would adversely impact the surrounding
neighborhood. My concerns include limited street parking, overuse of unimproved alleys, and the
specific traffic patterns of this area.
STREET PARKING On street parking in this area is already in short supply on the side streets of
Oak, Maple, Hazel and Russell. The parking on these streets is being used by currant residents
because they don't have enough space on their property to park. If additional housing is added to
this neighborhood, the number of cars needing a place to park is quickly going to exceed the
capacity of our parking. Multiple unit apartment buildings with three adults each would quickly
use the little available street parking on our side streets. State law allows three unrelated adults to
occupy one housing unit but the parking requirements for housing does not required three parking
spaces per unit. Excess renters' vehicles end up parked on side streets. Due to our present
limited parking on side streets, this will be a problem. Visitors will need to park on the side
streets because visitor parking is not required on-site.
ALLEY PROBLEMS Access to parking areas on the properties in these three half blocks is
limited by a narrow unimproved alley. The graveled area is only about ten feet wide. Three feet
on each side is grass and higher then the gravel area. Passing a car in the alley is a problem.
Large utility poles along the alleys are inside the alley bounders of 16 feet. Existing garages along
the alleys are blind spots for traffic. The houses and trees limit visibility for pedestrians and other
cars at alley entrances. The alleys are unimproved, narrow, and minimally maintained and are not
designed for usage by the number of cars a higher density housing projects would add to their
existing usage. Snow removal is a problem. Alley snow removal has the same priority as bike
paths.
NEIGHBORHOOD TRAFFIC PATTERNS The neighborhood has no streets opening to the
East and west, one to the North, and the six street intersections on Lincolnway. This limits the
entry and egress of traffic to the neighborhood. Vehicles going to the properties along
Lincolnway must travel through the neighborhood streets and alley to reach these properties.
They can't go there directly from Lincolnway or sixth street. The DOT has not yet finished the
remodeling on the old St. Cecila building. There are one hundred and twenty-five parking places
that will be used by the DOT staff on that site when remodeling is finished. I believe this will
effect traffic when completed. This lot will not be useful for overflow parking.
Attached is a survey of parking for the three half blocks and adjacent streets. The areas with the
most rentals have the most cars. Cars associated with rentals on Lincoln Way can be found on
side streets. The larger the rental, the more cars associated with it.

Dear Members,
As the owner of property on the north side of Lincoln Way in
the 1200 block, I ask you to deny the request to initiate
rezoning my land from R-3 to R-2. The need for multi-family
housing in close proximity to Iowa State University and the
Iowa Department of Transportation headquarters is acute, as
is evidenced by the large number of requests we receive from
prospective tenants. It seems logical that this need be
served by those properties contiguous to four-lane arterials
such as Lincoln Way, leaving the buffered land to be
occupied by single-family and two-family residences. By
down-zoning this area, you effectively eliminate that
potential, thereby forcing multi-family residents to the
periphery of town. Multi-family residents deserve the same
amenities as single- and two-family citizens within the
constraints of equitable zoning and other logical
considerations. This property was purchased with the intent
of providing the renting residents of Ames with affordable
housing within walking or biking distance to the major
employment centers mentioned earlier. It is easy and
politically popular to say, "Fine, but not in my
neighborhood. " However, the Planning and Zoning Commission
is charged with recommending what is best for the entire
population. I ask you to do so in this matter, and continue
the zoning that has worked well in the past.
The City staff has reviewed this request also, and has
recommended that the zoning change be denied. Given this,
and considering the strategic location of my property on
this busiest of all streets and the fact that it is on the
Cy-Ride route, it seems that the highest and best use of
this land for the present and future welfare of the entire
community is to leave the zoning as is.

Greetings,
I am writing this letter in protest of the proposed down zoning of the R3 and R4
residential area north of Lincoln Way between N. Oak and N. Russell Avenues. I am the
owner in a partnership of a house at 1111 Lincoln Way. We purchased this house in
December of 1988, as a rental with the full understanding that the area was zoned R3.
Down zoning this area would decrease the earning potential of our property without due
compensation. This area has been stable over the years and serves as a screen for Lincoln
Way. I see little that will change that in the future. These lots facing Lincoln Way have
little appeal as single family dwellings and serve mostly as rentals. Only 4-5 of the lots
affected are owner occupied.
I am also angry at the lack of dialog exhibited leading up to this being brought up for a
vote. As an owner directly affected I first became aware that this was being considered
when the letter arrived at our house on Wednesday, October 8, 1997. I am also disturbed
that I am only given 36 hours in which to give a written response to be included in your
information packet in this matter. Who is driving this request? The letter indicates the
request comes from the City Council. t have seen nothing in the newspaper accounts of
the Council meetings that this was asked for by the Council directly. I think that those of
us who have something at stake deserve a better explanation than what is given.
I also understand that City staff have recommended against this proposal. The vast
majority of property owners in this area are against this proposal.

Dear Council Members:
We are writing in reference to rezoning of the 1.42 acres from R-4 to R-2 in the
half-block of Lincoln Way between North Oak Avenue and North Maple Avenue
and rezoning of 2.84 acres from R-3 to R-2 in the two half-blocks north of Lincoln
Way between North Maple Avenue and North Russell Avenue. We are the
owners of two properties within this area and are concerned as to the impact of
the rezoning on the properties in the area.
We are writing to ask that you vote no to the rezoning request as we feel that the
change of zoning is taking property right from us. As existing property owners
we purchased the properties with the present R-3 zoning designation and know
that the change in zoning to R-2 will have a negative impact on the value of land
upon which our properties are located.
We understand the concern of the surrounding property owners, however, the
present zoning was in force when they purchased their properties and therefore
they were aware of what could develop on the adjoining R-3 properties. It
appears to us that the rezoning will be taking value from the existing owners in
the R-3 zoning area and giving value to the surrounding property owners.
We would ask that all property owners in the area be treated equally and fairly.
We feel that equal and fair treatment would require that the zoning remain as it
exists today.

In regard to the property that you will be considering to be
rezoned ordinance from R-4, high-density to R-2
low-density, generally located in the half-block North of
Lincoln Way and North Oak Ave, and the two half-blocks North
of Lincoln Way between North Russell Ave and North Maple Ave
from R-3 MediumO-Density to R-2 Low-Density should be
disapproved, as this would be spot zoning, which the City
Council of Ames has been against in the past . It is
suggested that if the ordinance is to be changed the
property should be upgraded to Commercial or all of it should
be zoned to R-4 High-Density.
I own property that could be effected by this zoning. The
following property is located at 121 S Maple, 225 N Hazel ,
1204 N 3rd, 1208 N 3rd, 1214 N 3rd and 1218 N 3rd St .
I would strongly object to any spot zoning or down grading of
property in this area .
