Re: Request for Amendment to §5.2.14, sub. (4) of the Ames Sign Regulations
Dear John:
This will respond to your question as to whether the pylon sign proposed for con-
struction on South Duff Avenue (referred to in my letter of September 18) is a "billboard"
as that term is defined in §29.82, sub. (1) of the City of Ames ordinances. I visited this
morning with: Pat Daly of The Daly Group. M.T. Daly conf nned that the proposed sign
will display identification only for three businesses in the shopping center, namely,
Cinemark Theaters, Staples Store, and A1di Food Store. The placement of a sign and
identification of the business is a property right associated with real estate titles in the
shopping center. The ability to identi Cy the business on the proposed pylon sign is regu-
lated by a reciprocal easement agreement between the owners of the property within the
shopping center.
None of the identified businesses will make a rental payment or pay a fee for the
:right to identify their business on the proposed sign. None of the businesses have the
right to permit any other business, person, or entity to advertise on the proposed pylon
sigh. I do not believe the proposed sign is a "billboard" as that teem is defined in §29.82,
sub. (1).
