COUNCIL ACTION FORM
SUBJECT: MOTION TO APPROVE THE REZONING OF PROPERTY GENERALLY
LOCATED WEST OF GRAND AVENUE, NORTH OF WHEELER STREET AND SOUTH
OF BLOOMINGTON ROAD, FROM R-2 and R-3 TO R-2 PUD, R-3 PUD, AND P-C
PLANNED COMMERCIAL.
ACTION FORM SUMMARY: This is a request to rezone 13.71 acres of land, as described
above.
Approval of this rezoning request is recommended.
BACKGROUND:
The applicants are requesting that the City rezone 13.71 acres of land, generally located
west of Grand Avenue, north of Wheeler Street and south of Bloomington Road as follows:
• 3.97 acres from R-3 to P-C;
• 3.46 acres from R-3 to R-3 PUD;
• 0.29 acres from R-3 to R-2 PUD;
• 3.83 acres from R-2 to R-2 PUD; and,
• 2.16 acres from R-2 to R-3.
A graphic showing the subject property and the proposed zoning designations is attached.
A request for approval of a Conceptual Development Plan (C.D.P.) for the subject property
is being processed concurrently with the request for rezoning.
Applications for approval of a PUD Plan and a P-C Plan have not yet been submitted
to the City. Submittal and approval of the PUD Plan will occur prior to the last
reading of the PUD ordinance by City Council.
A Land Use Policy Plan (LUPP) Map Amendment was approved by the City Council on
March 4, 1997, for the subject property consistent with the recommendation from the
Planning and Zoning Commission. The LUPP Map Amendment expanded the amount of
land designated for commercial land use to a small degree.
ANALYSIS:
Zoning District. The subject property is located inside the corporate limits. Portions of
the subject property are included in each of the following zoning districts:
• R-2 (Low-Density Residential);
• R-3 (Medium-Density Residential); and,
• P-C (Planned Commercial).
1988 and 1996 Land Use Policy Plans (LUPP). The Planning and Zoning Commission
reviewed the goals; and policies of both the 1988 and 1996 Land Use Policy Plans as part
of the analysis of the Land Use Policy Plan Map Amendment on February 19, 1997. It was
determined that the LUPP Map Amendment was consistent with the provisions of the
LUPP and was approved by the City Council on March 4, 1997.
City staff believe the proposed rezoning is consistent with the amended LUPP Map.
Utilities. Existing utilities are adequate to serve development in the area proposed for
rezoning. Please refer to the Commission Action Form that analyzes the Conceptual
Development Plan (C.D.P.) for further detail regarding the utilities.
Fire Department Response Time. The estimated Fire Department response time is 4.0
minutes to the intersection of Grand Avenue and Wheeler Street. Five (5) minutes is the
standard that the Fire Service uses for fire and first aid response.
Access/Traffic Impact. Please refer to the Commission Action Form that analyzes the
Conceptual Development Plan (C.D.P.) for a discussion of access and traffic impact of the
proposed development.
Impermissible Uses. At the time property is rezoned to P-C (Planned Commercial), a list
of impermissible uses must be established for the property.
The list of impermissible uses would include the following:
• Dwelling;
• Grocery, Fruit or Vegetable Store;
• Hotel/Motel;
• Parking Lot; and,
• Residential Corrections Facility.
All other uses allowed in a P-C district would be permitted and are described as follows:
• Apothecary Shop;
• Barber Shop;
• Beauty Shop;
• Business Office;
• Gasoline Service Station;

• Professional Office;
• Restaurant;
• Retail Store (for specific & general merchandise); and,
• Studio...Photography, Artist, Dance or Musician.
STAFF COMMENTS:
Staff believes the proposed rezoning is consistent with the LUPP Map designation and the
1988 and 1996 Land Use Policy Plans. Therefore, the subject property should be rezoned
to enable development.
RECOMMENDATION OF THE PLANNING & ZONING COMMISSION:
The Planning and Zoning Commission reviewed this request at their meeting of March 19,
1997 and recommended that the request for rezoning be approved, including the list of
impermissible uses in the proposed P-C district.
ALTERNATIVES:
1 . The City Couincil can approve this request to rezone land generally located west of
Grand Avenue, north of Wheeler Street and south of Bloomington Road, that
includes 3.97 acres from R-3 to P-C; 3.46 acres from R-3 to R-3 PUD; 0.29 acres
from R-3 to R-2 PUD; 3.83 acres from R-2 to R-2 PUD; and, 2.16 acres from R-2 to
R-3, with the following stipulation:
• The list of impermissible uses for the P-C (Planned Commercial) district
include:
A. Dwelling;
B. Grocery, Fruit or Vegetable Store;
C. Hotel/Motel;
D. Parking Lot; and,
E. Residential Corrections Facility.
F. Commercial uses where the size of the commercial structure exceeds the
size intent, as stated in the Land Use Policy Plan.
2. The City Council can deny approval of this request to rezone land generally located
west of Grand Avenue, north of Wheeler Street and south of Bloomington Road, that
includes 3.97 acres from R-3 to P-C; 3.46 acres from R-3 to R-3 PUD; 0.29 acres
from R-3 to R-2 PUD; 3.83 acres from R-2 to R-2 PUD; and, 2.16 acres from R-2 to
R-3.

3. The City Council can approve this request to rezone land generally located west of
Grand Avenue, north of Wheeler Street and south of Bloomington Road, that
includes 3.97 acres from R-3 to P-C; 3.46 acres from R-3 to R-3 PUD; 0.29 acres
from R-3 to R-2 PUD; 3.83 acres from R-2 to R-2 PUD; and, 2.16 acres from R-2 to
R-3, with modifications, including the following stipulation:
• The list of impermissible uses for the P-C (Planned Commercial) district
include:
A. Dwelling;
B. Grocery, Fruit or Vegetable Store;
C. Hotel/Motel;
D. Parking Lot; and,
E. Residential Corrections Facility.
F. Commercial uses where the size of the commercial structure exceeds the
size intent, as stated in the Land Use Policy Plan.
4. Action on this request can be postponed and referred back to City staff and/or the
applicant for additional information.
RECOMMENDED ACTION:
It is recommended that Alternative#1 be adopted. Alternative #1 is approval of the request
to rezone land generally located west of Grand Avenue, north of Wheeler Street and south
of Bloomington Road, that includes 3.97 acres from R-3 to P-C; 3.46 acres from R-3 to R-3
PUD; 0.29 acres from R-3 to R-2 PUD; 3.83 acres from R-2 to R-2 PUD; and, 2.16 acres
from R-2 to R-3, with the following stipulation:
• The list of impermissible uses for the P-C (Planned Commercial) district include:
A. Dwelling;
B. Grocery, Fruit or Vegetable Store;
C. Hotel/Motel-
D. Parking Lot; and,
E. Residential Corrections Facility.
F. Commercial uses where the size of the commercial structure exceeds the size
intent, as stated in the Land Use Policy Plan.
Further, it is the recommendation that the PUD Plan for this property be submitted
to the City and approved by the City Council prior to the last reading of the ordinance
enacting the PUD overlay.
