to be a covenant running with land described as set out on Appendix P attached hereto was made

and entered into effective the day of , 1997. However,this Agreement shall V
not be binding with respect to any officially platted lot for which a City building permit has been
issued. The said agreement was made for the purpose of establishing conditions that are in addition
to existing regulations of the City of Ames,as provided for by Section 414.5,Code of Iowa, and,with
respect to public improvements required by the City of Ames as a condition to approval of a plat of
subdivision of the above described land per Section 354.8,Code of Iowa. Said agreement is on file
inahe:.Office of the City Clerk of the City of Ames,Iowa.
