Be it ordained by the city council of!
the City of Ames, Iowa, l
See. I.—That from and after the pass-r I
j ,rge of this ordinate and- its publication
f as of by law, it shall be unlawful
for the owner of any lot, or parcel of
. round within the platted portion of the
"'-- City of Ames to allow to exist or remain '
any building or structure which is clan-
;erous and liable to fall at any place
where it would be dangerous to the in- p
habitants of the city.
Sec. 2. Whenever a complaint shall be
i filed with the Mayor of the City, or
whenever the Mayor shall receive notice
ur information that such a building ex-
ists in the said city, and under the con- +
ditions above set forth, he shall cause '
to be served upon the owner of said real
astate, if within. the City- of Ames, if not
upon the person in possession and control F
thereof, a notice in writing to appear be-
ore the nest regular meeting of the '
h pity council, or before any special meet-
trig that he may call for the
y .tnd there show cause why the
said
d building or structure should not be or-
e tiered repaired, removed or destroyed.
Sec. 2. That at the said meeting the i
:aid owner may present any evidence lie
may have showing that the said build-
in„ is not dangerous and is not liable to _
fall. That after such hearing the said ,
f council may by resolution make such or-
der as they may deem proper. If it finds
that the said building is dangerous and I
Y liable to fall, anti the condition of the
i. building permits, it may give to the
owner a certain fixed time in which to
repair, remove or destroy- the same, or l }
to comply with any order of the coun-
! cil. 1
II Sec. 4. If in the judgment of the > !
council, delay in the removal or destruc- IIII tion of the said building;is dangerous and
i inadvisable it may direct the City Alan-
( ager of Engineering or such other offi-
i cer as it may designate to take immediate '
steps to remove, tear down or destroy-, all I
► or any porton of the said building, that n 1
may be necessary to remove tire said : -
dangerous condition. \
Sec. 5. That in the case it is neces-
sari, to follow the procedure of the pre-
ceding section, or in case it is necessary
1 to order removal or destruction, the coon-
ell shall on the report of the cost and
expense of the said removal, repair or 't
destruction by the said Engineer and
upon such notice is it may direct to the \
owner. Si eciolly assess such costs and
expense against the real estate upon C`
which -he said building is located.
Sec. 6. The said council may, iu its
i discretion instead of making a special
assessment against the said real estate,
direct the City Solicitor to commence an
action of law in the proper court for the $
collection of said cost and expense. i
Sec i. Anilperson found guilty of vi-
olating the provisions of section one of
this ordinance shill be fined a sum not
exceedingone hunched dollar, and costs i
and in default of payment of the same
shall be committed to the city or county
