COUNCIL ACTION FORM
SUBJECT: PUBLIC HEARING TO CONSIDER THE PASSAGE OF AN ORDINANCE
EXTENDING THE DEMOLITION MORATORIUM OVERLAY DISTRICT.
ACTION FORM SUMMARY: The City Council is being requested to extend the
Demolition Moratorium Overlay District in the Central Ames area.
Staff is recommending that the Demolition Moratorium Overlay District be approved
again.
BACKGROUND:
On July 12, 1996 the City Council approved an ordinance prohibiting the demolition of
principle buildings in the Central Ames area. This ordinance is applicable for a six
month period with the potential of an additional six month period after the City Council
adopts another ordinance extending the moratorium.
ANALYSIS:
The purpose of this ordinance is to create a temporary means to preserve
principle buildings in an area for which a proposed change in zoning regulations
is under consideration to conserve that area's residential character
(Single-Family Conservation Overlay District regulations, SFCOD).
On January 7, 1997 the City Council directed that an overlay zoning ordinance be
prepared to limit the additional development of multiple-family structures based on a
percentage limitation of the acres in the moratorium area, and also incorporate a series
of Compatibility Standards into the ordinance. This is the proposed SFCOD as
modified by the direction of the Council.
The earliest that the proposed SFCOD ordinance would be considered by the City
Council would be January 28, 1997. This date is past the date at which the moratorium
ordinance expires.
Since the original purpose of the moratorium ordinance is to temporarily preserve
principle buildings from demolition until a new ordinance is adopted, it would be equally
important to continue the moratorium again until the new SFCOD ordinance is adopted
and becomes effective.
At the point when the City Council does adopt the SFCOD ordinance, it will then be
expected that the moratorium overlay district ordinance would be repealed.
STAFF COMMENTS:
Staff estimates that it could take as few as 18 days, or as many as 39 days to adopt the
proposed Single-Family Conservation Overlay District regulations, assuming the City
Council is agreeable to doing so and would follow normal meeting schedules. Because
of this, there would be a gap of time between the expiration of the moratorium
ordinance, and the adoption of the proposed SFCOD. Given the importance of
maintaining the integrity of the area until the new SFCOD regulations are adopted, the
passage of the ordinance to extend the moratorium ordinance is still important in
preserving the principle buildings in the area.
A copy of a map showing the moratorium area is attached to this Council Action Form.
ALTERNATIVES:
1 . The City Council can approve the extension of the moratorium ordinance.
2. The City Council can deny approval of the extension of the moratorium ordinance.
3. Action on this request can be postponed and referred back to City staff for
additional information.
RECOMMENDED ACTION:
It is recommended that Alternative #1 be adopted. Alternative #1 is an approval of the
extension of the moratorium district overlay ordinance. This will maintain the integrity of
the area by prohibiting the removal of principle buildings as set forth in the moratorium
ordinance.
To maintain the continuity of the moratorium ordinance, the City Council would need to
suspend the rules and adopt this ordinance to extend the moratorium district overlay on
all three reading at the special meeting of January 10, 1997.
