HomeMy WebLinkAboutA005 - Council Action Form dated August 27, 1996 ITEM#: DATE: 08/27/96 COUNCIL ACTION FORM SUBJECT: DISCUSSION OF PROPOSED BILLBOARD ORDINANCE AND DIRECTING THE CITY ATTORNEY TO REVISE THE ORDINANCE TO INCORPORATE PLANNING AND ZONING COMMISSION RECOMMENDATION. ACTION FORM SUMMARY: The Planning and Zoning Commission reviewed the proposed Billboard Ordinance at their meeting of August 7, 1996, and recommended that the ordinance be approved by the City Council with several revisions. Staff is recommending that two of the four revisions be approved and that the City Council direct the City Attorney to incorporate these revisions into the ordinance. BACKGROUND: At the Planning and Zoning Commission meeting of August 7, 1996, the Commission reviewed the proposed ordinance for billboards. In general, the Planning and Zoning Commission was favorable to the proposed ordinance as it has been prepared. To review, the ordinance contains the following major components. 1 . Definition of billboards. 2. Limits on the message area of 200 square feet, except along U.S. Highway 30, where 300 square feet is permitted 3. Monopole requirement. 4. Landscaping requirements. 5. Setback requirement equal to the height of the sign. 6. Uplighting restricted between the hours of 10:00 p.m. and 6:00 a.m. 7. Cap and replace provision. There are numerous other details of the ordinance that are more clearly stated in the proposed ordinance, but these represent the major features. Upon review by the Planning and Zoning Commission, they offered the following revisions to the proposed ordinance: 1 . That no landscaping requirement occur where billboards are located in agricultural zones, especially along U.S. Highway 30. The City Council can further direct that the City Attorney incorporate these changes into the proposed ordinance 2. The City Council can approve the revisions to the billboard ordinance, which include the following changes: A. Eliminate the landscaping standard in agricultural zones. B. Change the lighting restriction to the hours of 12:00 a.m. to 6:00 a.m. All other provisions of the ordinance would remain as originally proposed. Additionally, the City Council can direct the City Attorney to incorporate these changes into the proposed ordinance 3. The City Council can approve the billboard ordinance as originally proposed and not incorporate any of the revisions as recommended by the Planning and Zoning Commission. 4. The City Council can decide not to adopt any amendments to the existing billboard ordinance and not consider this issue any further. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #2. The review of this proposed ordinance by the Planning and Zoning Commission has created improvements to the ordinance that staff is favorable to with respect to eliminating the landscaping requirement in agricultural zones. The proposed change of the lighting restriction to the hours of 12:00 a.m. to 6:00 a.m. does not constitute a significant change in the judgement of staff. Staff does believe that the original proposal to limit the message area to 200 square feet in areas other than along U.S. Highway 30, and establishing a setback equal to the height of the billboard, will create a better result and be more in the public interest than the revisions as proposed by the Planning and Zoning Commission.
