HomeMy WebLinkAboutA001 - Council Aciton Form dated May 14, 1996 ITEM # Y DATE COUNCIL ACTION FORM SUBJECT: Develop Ordinance Prohibiting Possession of Alcoholic Liquor, Wine, or Beer Under Legal Age: 18-, 19-, 20-Year-Olds BACKGROUND: Several city ordinances mirror state codes relating to alcohol offenses. Currently, there is no city ordinance dealing with minors in possession of alcoholic liquor, wine, or beer, as specified under Iowa Code 123.47A. This situation has caused split prosecutions, city/state, in cases where officers have cited an individual for two separate offenses, e.g., Minor on the Premises and Possession of Alcoholic Liquor, Wine, or Beer Under Age. Adoption of a municipal ordinance dealing with Possession of Alcoholic Liquor, Wine, or Beer Under Age would allow greater flexibility for officers and prosecutors in dealing with alcohol offenses. ALTERNATIVES: 1. Direct the City Attorney to draft a municipal ordinance similar to Iowa Code Section 123.47A (Possession of Alcoholic Liquor, Wine, or Beer as a Minor). 2. Take no action. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1 to direct the City Attorney to draft a municipal ordinance similar to Iowa Code Section 123.47A (Possession of Alcoholic Liquor, Wine, or Beer as a Minor).
