STAFF REPORT
IRRIGATION PERMITS
On April 9, 1996, Alan Essex of Iowa Irrigation spoke at the public forum during the City
Council meeting regarding denial of irrigation permits he received from the plumbing inspector.
The reason for denial was that the water service was not large enough to handle the additional
fixture units placed upon it by the installation of the irrigation system based on the assumption
of using the Uniform Plumbing Code table 10-2; 30-45 pounds per square inch of water
pressure. The City Council asked him to prepare written changes to the existing ordinance
and have staff and the Plumbing Code Board of Appeals review them and make a
recommendation for the April 23, 1996, Council meeting.
Mr. Essex's proposal looks at using the pressure at each site to determine if the system will
be adequate. He also proposed to allow for booster pumps on systems below 45 psi. (See
attached copy.)
Personnel from public works, water pollution control, city manager's office, fire and inspections
met to discuss options with regard to Mr. Essex's proposal. After a lengthy discussion it was
determined that the issue is much more complex than whether or not to install irrigation
systems at a few locations. This is a much larger picture where we need to look at system
wide pressures and the variation of them for domestic, fire suppression and irrigation uses.
Therefore, the staff feels a workshop with the City Council is needed first, to educate and
inform the members about the complexity of the issue.
The Plumbing Code Board of Appeals also met and discussed several options at length.
They also agreed that a workshop is the best first step and they would welcome the
opportunity to participate in such an event. However, they also felt that this should be done
immediately to alleviate existing problems of design and installation of plumbing systems
based on our interpretation and enforcement of the Uniform Plumbing Code and State
Addenda. They also felt that if this workshop did not take place very soon, they would
propose temporary relief from the code on a job by job basis until such a meeting could occur.
The recommendation the Board is prepared to make temporarily is to repeal the statement in
our local plumbing code requiring staff to use the "low chart" in the 1991 Uniform Plumbing
Code assuming 30-45 PSI of water pressure (see attachment). [They feel the water pressure
shall be measured at each site and then the appropriate table should be used. This
recommendation would expand the action taken beyond irrigation systems to all domestic
and irrigation systems. The staff feels this may be too drastic at this point. Staff is especially
concerned about the possible drops in system pressure in the future and the repercussions
that may have on our water service customers.] If staff were pressed for a recommended
change prior to the workshop, staff may recommend a move to the middle table if a degree
of conservatism is figured into the calculation to accommodate future drops in system
pressure. See example.

70 > 65, therefore table 2 could be used.
The 20 and 65 are variables which could be raised or lowered to vary the degree of
conservatism. Such a recommendation would be made only as a temporary solution until the
City Council could review the water pressure policies in a workshop.
The city staff and the Plumbing Code Board of Appeals are asking for guidance. If the City
Council Members wish to take some immediate action on April 23, 1996, the City Attorney
could be directed to draft an appropriate ordinance change to be brought back to the Council
on May 14, 1996. The Board would then hold their required public hearing on the proposed
prior to that date.

Sec. 21 .701 . IRRIGATION SYSTEM PERMIT REQUIRED.
(1) No person shall sell, install or operate an irrigation
system with respect to any premises or place in the City of Ames
unless and until the City of Ames Plumbing Inspector has issued a
permit for the irrigation system with respect to that place or
premises.
(2) The said irrigation permit shall be issued only after it
has been shown to the reasonable satisfaction of the plumbing
Inspector that the proposed irrigation system is designed to
function properly with consideration to the given static water
pressure and that the design does not exceeding the recommended
flow of the water service for that place or premises. If the static
water pressure is below 45 PSI then a booster pump set-up shall be
installed for that place or premises and the irrigation system to
function properly.

ORDINANCE NO. 3337
AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF
AMES, IOWA, BY REPEALING SECTION 21.701 AND ENACTING NEW
SECTIONS 21.701 AND 21.801 FOR THE PURPOSE OF REQUIRING A
PERMIT FOR THE INSTALLATION OF IRRIGATION SYSTEMS;
REPEALING ANY AND ALL ORDINANCES OR PARTS OF ORDINANCES :
IN CONFLICT TO THE EXTENT OF SUCH CONFLICT; PROVIDING A
PENALTY; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, it has been found that irrigation systems have been sold and installed at premises where the
size of the water service relative to the pre-existing demands on the service resulted in the water supply being
inadequate to drive the irrigation system; and,
WHEREAS, it is deemed to be in the public interest that before an irrigation system is sold and installed
for any place that the water service and existing demands for water at that place be evaluated by.the plumbing
inspector to determine if there is sufficient water service at that place to meet the water demands that will be
presented by the addition of an irrigation system.
NOW, THEREFORE, BE IT ORDAINED by the Ciy Council for the City of Ames, Iowa:
Section One. The Municipal Code of the City of Ames, Iowa shall be and the same is hereby amended by
repealing Section 21.701 and enacting new Sections 21.701 and 21.801 as follows:
"ARTICLE VII
IRRIGATION SYSTEMS
See. 21.701. IRRIGATION SYSTEM PERMIT REQUIRED.
(1) No person shall sell, install or operate an irrigation system with respect to any
premises or place in the City of Ames unless and until the City of Ames Plumbing Inspector has
issued a permit for the irrigation system with respect to that place or premises.
(2) The said irrigation permit shall be issued only after it has been shown to the
reasonable satisfaction of the plumbing inspector that the water service to the premises is sufficient,
in view of the existing water using facilities at the place of proposed installation, for the proper
operation of the proposed irrigation.system.
ARTICLE VIR
PENALTY
Sec. 21.801. PENALTY.
Any person, corporation or other legal entity who violates or resists the enforcement of
any of the provision of this chapter commits a municipal infraction punishable by a civil penalty
of thirty dollars ($30) for the initial offense, one hundred dollars ($100) for the second offense,
and two hundred dollars ($200) for each repeat offense. Each day that a municipal infraction
occurs constitutes a separate offense. Any person, corporation or other legal entity who violates
this ordinance after having previously been found guilty of violating the same ordinance provision
at the same location or at a different location shall be considered to have committed a repeat
offense. Seeking a civil penalty as authorized in this section does not preclude the city from
seeking alternative relief, including an order for abatement or injunctive relief."
Section Two. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of
such conflict, if any.
