HomeMy WebLinkAbout~Master - Prohibiting Parking on portions of Welch Avenue, tow-away zones for snow removal ORDINANCE NO. 3375 AN ORDINANCE TO AMEND THE MUNICIPAL CODE OF THE CITY OF AMES,IOWA,BY REPEALING SUBSECTION 18.31(189),SUBSECTION 22.9(64)AND SECTION 22.10 FOR THE PURPOSE OF PROHIBITING PARKING ON A PORTION OF WELCH AVENUE AND DESIGNATING CERTAIN PORTIONS OF CERTAIN STREETS AS A COMMERCIAL TOW AWAY ZONE FOR SNOW REMOVAL;REPEALING ANY AND ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT TO THE EXTENT OF SUCH CONFLICT; PROVIDING A PENALTY;AND ESTABLISHING AN EFFECTIVE DATE. BE IT ENACTED,by the City Council for the City of Ames,Iowa,that: Section One. The Municipal Code of the City of Ames,Iowa shall be and the same is hereby amended by repealing Subsection 18.31(189)as it now exists and reenacting a new Subsection 18.31(189)as follows: "(189) WELCH AVENUE. (a) Parking is prohibited on the west side between 2:00 a.m.and 6:00 a.m. from Lincoln Way to Storm Street. (b) Parking is prohibited on the east side between 2:00 a.m.and 6:00 a.m.from Lincoln Way to Hunt Street. (c) Parking is prohibited at all times on the east side from Hunt Street to Storm Street." Section Two. The Municipal Code of the City of Ames,Iowa shall be and the same is hereby further amended by repealing Subsection 22.9(64)as it now exists and reenacting a new Subsection 22.9(64)as follows: "(64) Welch Avenue on the east side from the south line of Hunt Street to its intersection with Storm Street." Section Three. The Municipal Code of the City of Ames,Iowa shall be and the same is hereby further amended by repealing Section 22.10 as it now exists and reenacting a new Section 22.10 as follows: "Sec.22.10. COMMERCIAL TOW-AWAY ZONES FOR SNOW REMOVAL. (1) Vehicles parked in violation of the provisions of Section 18.22(1)of this Code shall be towed when found so parked after posting of snow removal,tow-away notice signs or boxes for a period of at least eight hours, so that those high density commercial areas can be cleared of snow to prevent aggravated traffic congestion and impedance of emergency vehicle access in a location where the consequences of such congestion or impedance could be of especially severe impact on public safety and well-being. (2) After especially heavy snow accumulations,the City Manager may post other streets with snow removal,tow-away notice signs,and cause the towing of vehicles parked contrary to such notice posted for more than twelve hours when such is deemed necessary to enable City crews to clear out snow from areas that had numerous parked cars or which for some other reason could not be effectively cleared of snow by ordinary snow plowing operations,so as to obviate the occurrence or continuance of a special hazard caused by the said condition. No. 2686, 10-17-78; Ord.No. 2836a, 12-7-82) (3) The following streets or portions of streets designated in this section shall,when official signs have been erected giving notice of such as a"Snow Route--Tow-Away Zone",be subject to Section 22.8 between the hours of 2:00 a.m.and 6:00 a.m.every day. (a) Clark Avenue from the north line of Lincoln Way to the south line of Sixth Street. (b) Kellogg Avenue from the north line of Lincoln Way to the south line of Sixth Street. (c) Lincoln Way from the east line of Sheldon Avenue to the west line of Lynn Avenue. (d) Welch Avenue on both sides from the south line of Lincoln Way to the south line of Hunt Street and on the west side from Hunt Street to Storm Street. (e) Burnett Avenue from the south line of Sixth Street to the north line of Main Street. (f) Douglas Avenue from the south line of Sixth Street to the north line of Main Street. (g) Fifth Street from the west line of Duff Avenue to the east line of Grand Avenue. (h) Main Street from the west line of Duff Avenue to the east line of Grand Avenue. (i) Pearle Street from the south line of Fifth Street to the north line of Main Street. 0) Chamberlain Street from the west line of Lynn Avenue to the east line of Hayward Avenue. (k) Hayward Avenue from the south line of Lincoln Way to the south line of Chamberlain Street;and on the east side only,from the south line of Chamberlain Street to 204.3'south of the south line of Storm Street. (Ord.No. 3230, Sec. 1, 6-22-93) (1) Stanton Avenue from the south line of Lincoln Way to the north line of Chamberlain Street. (Ord. No. 3149, Sec. 2, 11-12-91)" Section Four. Violation of the provisions of this ordinance shall constitute a simple misdemeanor punishable by a fine not to exceed$100 or by imprisonment not to exceed 30 days. Section Five. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict,if any. Section Six.
