COUNCIL ACTION FORM
SUBJECT: REZONING OF 18.47 ACRES OF LAND FROM A-1 (AGRICULTURAL,
STORY COUNTY) TO R1-6 (LOW-DENSITY RESIDENTIAL) GENERALLY LOCATED
SOUTH OF OAKWOOD ROAD AND WHITE OAK DRIVE.
ACTION FORM SUMMARY: This is a request to rezone 18.47 acres of land generally
located south of Oakwood Road and White Oak Drive for the purpose of single-family
residential development.
Approval of this request for rezoning is recommended.
BACKGROUND:
The applicant is requesting that the City rezone 18.47 acres, generally located south of
Oakwood Road and White Oak Drive, from A-1 (Agricultural, Story County) to R1-6
(Low-Density Residential).
The boundary survey and legal description are attached to this report.
The applicant proposes to develop a residential subdivision on the subject property.
A request for annexation of the subject property is being processed concurrently with the
request for rezoning.
The subject property is located at the limit of but within the M.U.S.A. (Municipal Urban
Service Area) for sanitary sewer. The M.U.S.A. includes land that is presently served by
public utilities and areas where extensions of existing utilities are planned in the future.
ANALYSIS:
Zoning District. The subject property is located in Story County and is presently zoned
as A-1 (Agricultural).

Land Use Policy Plan. The City Council approved a change to the Land Use Policy
Plan map, designating this area as being suitable for Low-Density Residential
development. This change was approved in March of 1994. The following goals and
policies from the Land Use Policy Plan (LUPP) apply to this LUPP Amendment proposal:
A. GENERAL
A.1. GOAL:
To develop land use patterns which make possible a safe and pleasant
environment and enhance social and economic welfare.
A.2. GOAL:
To plan land use for present needs and in anticipation of future land use
needs which take into consideration a population of 53,000 by the year
2000.
E. RESIDENTIAL
Community Priorities
• Maintain and enhance the integrity and character of existing
residential neighborhoods.
• Carefully review new developments to eliminate conflicts with existing
development and to ensure adequacy of City services.

B.1. GOAL:
To provide a wide choice of housing types and locations to serve the
residential needs of the present and future populations.
B.1.1. Policy:
The Land Use Policy Plan will serve as the basis to provide for functional
new developments, conservation and preservation of existing
neighborhoods and the rehabilitation and/or redevelopment of deteriorating
areas.
B.1.2. Policy•
New housing development will be located adjacent to existing development
to better utilize existing public facilities and to ensure the orderly growth of
the community.
H. PRIME AGRICULTURAL LAND/REDEVELOPMENT
H.1. GOAL:
To develop a land use pattern that encourages the preservation of prime
agricultural land and redevelopment of appropriate existing urbanized area.
H.1.1. Policy•
Concentration of new urban development will be encouraged so as to
reduce the impact on prime agricultural land by minimizing the amount of
land to be converted to urban uses.
• Conversion of land to urban uses will be allowed only after thorough
analysis of the natural environment and the potential impacts that
occur as a result of development.
Consistency of the Rezoning Proposal with the Goals and Policies Set Forth in the
Land Use Policy Plan (LUPP).
The proposed rezoning from A-1 (Agricultural, Story County) to R1-6 (Low-Density
Residential) is consistent with the LUPP Map designation of RL (Residential:
Low-Density). This rezoning will result in new housing located adjacent to existing
development and existing utilities, and it would provide an opportunity for additional
single-family housing in the community.
Conversion of the subject property from agricultural to more of an urban land use is in
conformance with the LUPP since the subject property is classified by Story County as
"low to moderate" value for agricultural purposes. This is not "prime agricultural land".

Utilities. Utilities are adequate to serve the proposed development.
Water: There is a 12-inch water main located along Oakwood Road.
Sanitary Sewer: There is an 8-inch sanitary sewer main located along White
Oak Drive. This must be reconstructed to lower the main to
serve the subject property.
Electric: Electric service would be provided by Iowa Electric Light and Power
Company to the proposed development. Existing electric facilities
are adequate to serve the proposed housing units.
Fire Department Response Time. The estimated fire department response time is 6.4
minutes from the time of alarm to the time of arrival. Five (5) minutes is the standard that
the fire service uses for fire and first aid response. The development of this area is in a
location that is 1 .4 minutes beyond the standard fire department response time.
Access/Traffic Impact. Approval of a subdivision plat for the subject property would
require access to the proposed subdivision from Oakwood Road (north) and from Cedar
Lane (west). Oakwood Road would be upgraded to a three-lane street adjacent to the
subject property. This would be part of the required public improvements for this
residential development.
Note: The cost of off-site improvements are the responsibility of the developer,
including lowering the sanitary sewer, improvements to Oakwood Road, a bicycle
path on the south side of Oakwood Road, and any other improvements identified
through the subdivision review process.
STAFF COMMENTS:
Staff believes the rezoning of this property is consistent with the LUPP designation and
the goals and policies of the LUPP. Therefore, the subject property should be rezoned
to allow the development of the land as a single-family residential subdivision.
PLANNING & ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission reviewed this request at their meeting of December
20, 1995 and recommended that it be approved.
ALTERNATIVES:
1 . That the City Council approve the request to rezone 18.47 acres, generally located
south of Oakwood Road and White Oak Drive, from A-1 (Agricultural, Story
County) to R1-6 (Low-Density Residential).
2. That the City Council deny approval of the request to rezone 18.47 acres,
generally located south of Oakwood Road and White Oak Drive, from A-1
(Agricultural, Story County) to R1-6 (Low-Density Residential).

3. Table this request for additional information from City staff and/or the developer.
RECOMMENDED ACTION:
Adoption of Alternative #1 . This would approve the request to rezone 18.47 acres,
generally located south of Oakwood Road and White Oak Drive, from A-1 (Agricultural,
Story County) to R1-6 (Low-Density Residential) upon action by the City Council. The
applicant must understand that as part of the subdivision platting for this site, an
agreement will be required by which all costs of off-site improvements are the
responsibility of the developer, including lowering the sanitary sewer, improvements to
Oakwood Road, a bicycle path on the south side of Oakwood Road, and any other
improvements identified through the subdivision review process.
