COUNCIL ACTION FORM
SUBJECT: PUBLIC HEARING TO CONSIDER A CHANGE IN THE PERMITTED USES
IN THE P-C (PLANNED COMMERCIAL) DISTRICT TO ALLOW A PARKING LOT AS
A PERMITTED USE.
ACTION FORM SUMMARY: This is a request to add a parking lot to the list of uses that
may be permitted in the P-C (Planned Commercial) zoning district.
Approval of this amendment to the P-C district is recommended.
BACKGROUND:
The City Council has initiated a change in the permitted uses in the P-C (Planned
Commercial) District to allow a parking lot as a principal use. The owner of property at
608 and 612 Burnett Avenue has requested that parking lots be added to the list of
permitted uses that may be allowed within the P-C (Planned Commercial) zoning district.
He would like to make this property available to the U.S. Post Office as a remote site for
a parking lot for postal vehicles and for employee parking.
This property has been used for many years for the storage of new and used vehicles for
a vehicle sales business, located at the corner of Burnett Avenue and Fifth street. The
use of this lot for vehicle storage predates the rezoning of this property to P-C (Planned
Commercial), which took place in 1983. Prior to that time the property was zoned C-C
(Concentrated Commercial) and C-4 (Retail Commercial). Staff believes the use of this
property for a parking lot for postal vehicles and employee parking for the U.S. Post office
is a change in use, and the proposed use, a parking lot is not listed as one of the
possible uses that are allowed in the P-C (Planned Commercial) zoning district. Parking
lots are permitted as accessory uses to the principal use of the property, however, to
allow a parking lot as a principal use, a parking lot would have to be added to the list of
uses that may be permitted in the P-C zoning district.
ANALYSIS.
The following uses may be permitted within the P-C zoning district under the current
regulations:
Section 29.24 (2) Use regulations. The following regulations and
procedures shall apply to the uses of land in a P-C
District:
(a) As a general rule the following uses shall be
permitted:
Apothecary shop
Barber shop
Beauty shop
Business office
Dwelling
Gasoline service station
Grocery, fruit or vegetable store
Hotel/motel
Professional office
Restaurant
Retail store (for specific and general merchandise)
Studio -- photography, artist, dance or musician
Residential Corrections Facility, if not nearer than
500 feet to another residential corrections facility
Staff believes adding a parking lot to the list of uses that may be permitted in the P-C
zoning district is appropriate and would be consistent with the other permitted uses
allowed as a general rule in the district, as well as with many of the uses generally found
in the areas surrounding the P-C zoning district. The parking lots would be landscaped,
and adequate buffers can be provided as part of the P-C Plan approval process in order
to assure compatibility with surrounding uses. And in those areas where a commercial
parking lot may have a detrimental impact on the surrounding area, the City Council can
include a parking lot on a list of impermissible uses for a particular piece of property that
is zoned P-C (Planned Commercial), as per Section 29.25(2)(b).
PLANNING AND ZONING COMMISSION RECOMMENDATION:
The Planning and Zoning Commission reviewed this request at their meeting of January
3, 1996 and recommended that it be approved.
ALTERNATIVES:
1 . That the City Council approve the proposed amendment to Section 29.24(2)(a) to
include a parking lot as one of the permitted uses allowed in the P-C zoning
district.
2. That the City Council not change Section 29.24(2)(a).
3. That the City Council approve a change to Section 29.24(2)(a) with modifications.
4. That this request be tabled for additional information from City staff.
RECOMMENDED ACTION:
Adoption of Alternative#1 is recommended. This alternative involves a change to Section
29.24(2)(a) to allow a parking lot as a permitted use of property in the P-C zoning district.
