COUNCIL ACTION FORM
SUBJECT: PUBLIC HEARING TO CONSIDER THE REZONING OF PROPERTY
NORTH OF EISENHOWER AVENUE, EAST OF HYDE AVENUE, IN
BLOOMINGTON HEIGHTS SUBDIVISION, FROM R-2 TO R-2 PUD.
ACTION FORM SUMMARY: The developers of Bloomington Court PUD have
requested a PUD Plan approval and have obtained this approval at the City Council
meeting of November 15, 1995. The City must also rezone the property as a PUD
overlay zone.
Staff is recommending that the City Council approve this PUD zoning ordinance
overlay.
BACKGROUND:
At the City Council meeting of November 14, 1995, the City Council approved the
PUD Plan for Bloomington Court. This PUD includes the development of 18
bi-attached townhomes and 64 condominium units in eight (8) condominium
structures.
Additionally, the PUD included the development of a system of private drives, internal
walk systems, two small gathering areas, and significant landscaping improvements.
The development is within the density allowance of the Land Use Policy Plan and
further documented by a Zoning Change Agreement that was approved at the time the
City rezoned the property to R-2.
Typically the PUD Plan approval and the approval of the PUD Zoning Ordinance
overlay are decided upon simultaneously. In this instance they are being processed
separately in that the legal description of the property to be rezoned was not given to
the City Clerk by the Planning Department in time to meet the public notice deadline.
Procedurally everything is acceptable in that the approval of the PUD Plan must
precede the ordinance decision.
The Planning and Zoning Commission reviewed this proposal at their meeting of
November 1, 1995 and recommended that this PUD be approved.
ALTERNATIVES:
1 . The City Council can approve the rezoning of the property in Bloomington
Heights Subdivision, located north of Eisenhower Avenue and east of Hyde
Avenue, from R-2 to R-2 PUD.
2. The City Council can deny approval of the rezoning of the property in
Bloomington Heights Subdivision, located north of Eisenhower Avenue and east
of Hyde Avenue, from R-2 to R-2 PUD.
3. The City Council can table action on this request and refer this request back to
staff and/or the applicant for additional information.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative
#1. This will approve the rezoning of the property in Bloomington Heights Subdivision,
located north of Eisenhower Avenue and east of Hyde Avenue, from R-2 to R-2 PUD.
